Federal authorities on Thursday charged a Tomah man with making threats to kill President Barack Obama during his visit to La Crosse Thursday.

A warrant was issued for Brian D. Dutcher, 55, who was charged Thursday with making a threat to kill the president. The threat was made in La Crosse on Wednesday, according to documents filed in U.S. District Court in Madison.

Dutcher was being kept in a mental health facility under a civil commitment sought by authorities in La Crosse County, U.S. Attorney John Vaudreuil said Thursday from La Crosse, where he was greeting Obama. Dutcher is not scheduled to appear in federal court.

On Wednesday, according to an affidavit written by Secret Service Special Agent Jeffrey Ferris, Dutcher approached a security guard at the La Crosse Public Library and said, “The usurper is here and if I get a chance, I’ll take him out and I’ll take the shot.”

Dutcher was interviewed by the Secret Service on Wednesday, when authorities said he confirmed the statement and said he had made similar statements on his Facebook page.

According to the affidavit, on Tuesday Dutcher wrote on his Facebook page, “That’s it! Thursday I will be in La Crosse. Hopefully I will get a clear shot at the pretend president. Killing him is our CONSTITUTIONAL DUTY!”

Dutcher told a La Crosse police detective that his threat was serious and he would not have said what he said if he didn’t intend to carry it out, the affidavit states.

The threat was not publicly visible on Dutcher’s Facebook page on Thursday, but he did comment to friends in another post: “I have been praying on going to D.C. for 3 months and now the upsurper is coming HERE. saving me a 800 mile trip. doing what I do for my daughter, so she can live free. pray for me to succeed in my mission.”

He added, “secret service is probably tracking my phone right now. I do not hide what I am doing, CONSTITUTIONALY.”

What I want to know is: what the gubmint is presently doing on the DL behind the scenes. Never fails something big is going down anytime there is a media storm.

Well, I suppose it's a good way to get moved to the head of the line of those waiting for mental health services. Three hots and a cot, and no rent to worry about. I'm not sure that was the motive here, although it just seems like he wanted to get caught and that he didn't have any serious plans of going through with it.

Another moron representing the 'honest and law abiding' gun owner's of America. I really do not understand why gun owners in the nation tolerate this sort of shit? Do they not realize this stuff undermines the grand total of their arguments for firearm ownership in the nation? This wacko and those like him (i.e. sovereign citizens) do more damage than all the liberals put together.

Just an FYI for those firing guns into the air as celebration of the 4th....

...Ammo going up will come back down (found under the Theory of Gravity). Either fire blanks, or take responsibility of whom gets hit by a bullet falling at terminal velocity.

Well, there`s a false notion by some that the 2nd Amendment is for citizens to "protect" themselves from the gubment.

To the point where some advocate, through code (sarah palin) or by outright sedition or calls for civil war (over gay cake?! Really?!).

There`s a kind of a "stand your ground" all encompassing justification/ violence encouragement meme pushed by the lunatic fringe.

As we sadly saw with Gabby Gifford`s attack,it`s not a matter of if a loon with act upon the violent rhetoric, but when.

Expect the right to say he`s a lone crazy guy and deny they fear monger society`s knuckle-draggers.

I think that fellow is of the school that takes the part of enlistment oat literally "... defend the constitution from enemies both foreign and domestic."

There are people out there that consider representatives like Feinstein, Claybrook, Clinton, and Obama some of those "domestic enemies" for their long standing assault on the constitution.

Personally, I find the "Constitutionalists" and their enemies list both cases of different sides of the same type of nut-job.

This is the natural course when nations get too much government. Unfortunately this has risen to the point that even the most legally ignorant can see they are being taken advantage of.

Why would anyone knowingly stand by and watch a complete breach of contract (the constitution) through constructive fraud as is happening in the american courts today?

can you level a convincing argument to that effect?

Back when I was just a very young skad (in the early 70s), my step-sister came home and did a "cheer".

It was a bastardization of the: "Two! Four! Six! Eight!" variety. The word that she chose to rhyme with "eight" was "assassinate".

My step-dad (A Korean war vet and - giving the devil his due - a good American) went ballistic on her. He sat us down and explained some of the facts of life and how you could hate the man's politics but threatening the president with physical harm was not only un-American, it was illegal and anti-Christian.

Needless to say, it was a lesson that stuck in my head and still does.

I would never advocate such a thing as the OP link. In fact, I would never wish any harm on any person; up to and including some of the more moronic denizens, here.

Like it or not, the man is the president of the United States and as with any other president, after he does pass, if given the opportunity, I would pour a bottle of my 75 year old scotch over his grave (of course, in this president's case, I'd want to pass it through my kidneys, first).

Which means more; legal precedent or the wording of the laws passed?

The courts seem to lend more credence to broad interpretations of prior rulings instead of each case being considered on the legal code and its own merits.
