A Connecticut jury sided against 54-year-old New Yorker Jennifer Connell after she sued her now-12-year old nephew for an incident several years ago in which he hugged her a little too hard, knocked her to the floor — and broke her wrist.

The then-8-year-old was pretty excited to see his aunt at his birthday party on March 18, 2011, according to the Connecticut Post. He had just gotten a two-wheel bike that day and was riding it around the home, the newspaper reported. He was so excited that he ran up to his aunt as soon as he saw her.

“Auntie Jen! Auntie Jen!” he exclaimed.

That’s when things got a little dangerous.

“All of a sudden he was there in the air, I had to catch him, and we tumbled onto the ground,” Connell testified, according to the Connecticut Post. “I remember him shouting, ‘Auntie Jen, I love you!’ And there he was flying at me.”

All 50 pounds of him.

The jury, according to the Connecticut Post, didn’t take more than 25 minutes to make their decision Tuesday.

What I wanna know.....
WHY would an apparently loved aunt, sue her neph first of all.
Why would an apparently loved aunt persist in a lawsuit after the mother died.
Hated the mother? or was she cut out of the will? or just major thundercuntishness?
Im so glad she lost.

This one popped up on Facebook. I read into it a bit: various legal sorts of people seemed to think that this wasn't an action driven by the auntie so much as her lawyers. Bizarre, though, if that was the case: why on earth would the lawyers in question think that they could win the case? Oh well. We live in very litigious times, so I hear.

If they didn't have to win to get paid......
Even if I thought I could win I would be embarassed to go before a judge and say I got hurt when an 8 year old hugged me. Bet she isn't invited over for Thanksgiving this year.

Update this afternoon:

Jennifer Connell, 54, said that she was forced to sue her nephew, who was 8 when the accident occurred, because it was the only way to get her homeowners insurance policy to pay for the cost of her care.

“This was meant to be a simple homeowners insurance case,” Connell told CNN. “Connecticut law is such that I was advised by counsel that this is the way a suit is meant to be worded.”

According to Connecticut law, the insurance company couldn’t be named in the lawsuit, so 12-year-old Sean Tarala was named as the defendant.

This seems to resolve the puzzling issue of what possessed the aunt to sue her nephew. At the end of the day, the absence of a 'socialised healthcare system' forced the aunt to pursue a very anti-social course of action to have her medical costs reimbursed. The waste of resources almost matched the waste of time this case was.

It's a very sad commentary on the for-profit shambles of the US healthcare 'system'.

well,.. not just (or even so much) the healthcare system, but the (liability) insurance industry.. I mean, why should the tax payers (or private) health care system pay when the homeowner had insurance and the insurance corp was playing stupid bugger (they apparently offered her $1 to settle for her medical bills).. US insurance corps are sleazy and will do whatever it takes not to pay a legit claim.. and I expect that the insurance industry lobbied state govt to make it difficult/impossible/illegal for them to be sued directly, etc.. In the US its the tail that wags the dog..
