Imagine that you are a tinkerer in your basement like my grandfather's nephew by marriage, Andy. (way back, Andy got a $20,000 grant from Chrysler to perfect the first aluminum crank window) presto, got his patent. Chrysler put these windows on their mobile homes, Andy receives royalties and eventually with other sales...become a multi-millionaire. But what if after the patent, GM and Ford (or any big co.) started using the same windows or even just made them and sold them ? Well, you might sue. At that point in time YOU become a patent troll. That's right. Even though it's YOUR invention but because you were only going to license it, YOU are now the Patent Troll...only looking to sue the actual thieves who stole your idea. Shame on you little guy. HERE You see, in today's corporate plutocracy, it is the biggies that get to steal your patent and outright develop products around it or even just incorporate it into their products and when you go after them and for reasons now unknown but because you were not a big co. and it's assumed you weren't going to manufacture or install or program or make use of your patent and ALL you were going to do was license it, you sue and YOU become a...Patent Troll. See, what you are doing when you sue to protect YOUR patent, is called abusive litigation. Isn't that precious ? You invent something, corporate America steals it and to sue for your patent rights, is now called...abusive litigation. This is 'rationalized' by claiming that too many otherwise shell corps. buy patents only to sue. But with the additional hurdles in front of you, what recourse do you or does any company have ? Either their are patent rights or there are not and to claim that lawsuits to protect either royalties or licensing is now 'abusive litigation' or you become a patent troll...innovation is done under these new patent laws. Recall the intermittent wiper seen on all cars now ? Everybody stole it, made million$ off of it and it took the inventor almost 30 years to get less then $30 million when his company could still be in business making him and his heirs a whole lot more than that over that time. Plus, he was going to create a company and invent other innovations, create jobs etc....innovate, the whole purpose of patent protection. But no, that didn't happen through corp, thievery. Now lawmakers want to essentially legalize that theft. Enter the corporate/congressional plutocrats and you get what. The America Invents Act of 2011 and it sails into law. That law makes it much more difficult for YOU to protect YOUR patent. With several new legal requirements in an amend. there needs to be clarification as to the additional responsibilities of you and your patent suit. Enter the Innovation Act of 2013 to further complicate matters for YOU. That got hung up in the senate. No problem. Enter the Innovation Act of 2015 and let the propaganda begin. HERE And people think we have free market...capitalism ? [sic]
