Five Cullman County residents – all supporters of Donald Trump – filed a federal lawsuit this week against 2016 Republican presidential candidate Ted Cruz, alleging that the Texas senator is ineligible for the presidency because he's not a natural born citizen.

The Drake Law Firm in Cullman sent the lawsuit to AL.com on Friday. The suit urges the court to declare Cruz "ineligible and disqualified to run/seek the office of president of the United States of America" because he was born in Canada in 1970.

Cruz has maintained that he is eligible to run because his mother was a U.S. citizen at the time of his birth. His campaign did not immediately respond to the lawsuit, filed in the U.S. District Court in the first of its kind filed in Alabama.

While the plaintiffs concede that Cruz is a citizen, they contend that Cruz is not a natural-born citizen. They cited a portion of the Constitution that says "no person except a natural-born citizen, or a citizen of the United States, at the time of the adoption of this constitution, shall be eligible to the office of president."

"Plaintiffs allege that at the time of Mr. Cruz's birth, the United States could not confer citizenship upon him under any law or legal theory that exists," the lawsuit states. "'Natural born' means native born within the United States or its dominions/territories. Canada is not a territory of the United States. Whether the Defendant's mother was/is a United State's [sic] citizen is irrelevant. If however, she had been an Ambassador to a foreign country; or, stationed in another country while serving in the military, such would not bar Mr. Cruz's candidacy."

Another article...with Trumps tweets, apparently I missed a lot this afternoon!!

http://talkingpointsmemo.com/livewire/donald-trump-lawsuit-threat-ted-cruz

Donald Trump on Friday afternoon threatened to sue Sen. Ted Cruz (R-TX) over his Canadian birth unless the Texas senator doesn't "clean up his act."

Trump was quick to question Cruz's eligibility to run for president, given that he was born in Canada to an American mother. The real estate mogul raised the question back in March 2015 when Cruz announced his presidential bid, and then brought it up again in January. Cruz has maintained that he is eligible to be president since he became a U.S. citizen at birth.

Trump's tweet on Friday followed several others earlier in the day attacking Cruz. He bashed Cruz after the Texas senator said that Trump accepted the Supreme Court ruling legalizing same-sex marriage.

Trump on Thursday accused Cruz of using "push polls" to attack him in South Carolina, but Cruz has said that his campaign is not behind the automated polls going out to voters.

Stupid lawsuit, the matter was settled when George Rommney ran in 1968 because when he was born his parents were in Mexico but both were US citizens.
It was tried when Goldwater ran in 1964 because Arizona was a territory when he was born.
It was also tried in 2008 with McCain because he was born off base in Panama when his father (a Captain in the U S Navy at the time) was based there.
It is a desperate attempt to stop Cruz because someone doesn't think Trump can do it straight up.

This is an old trick that has never worked.

If Dumbo-ears was eligible (simply based upon the fact that his piece of shit socialist mother {who renounced her citizenship, just not to anyone official} was an American citizen), then Cruz must be eligible, also.

For the record: I'm not sure either of them is eligible and I'm not sold on Rubio's eligibility, either (but it's obvious that Hillary shits her pants suit at the thought of running against him).

Five suits, originated by democrats claimed obama was not eligible. Each was denied for lack of standing to sue ( a reason for dismissal I find absolutely abhorrent). If this suit proceeds it will certainly show bias in the judicial system.

hahahahahahahahahahahahahahahahahahahahah
how
Orly taitz has made what 14 ???
none of them had standing, it didnt stop her...
I seem to remember back in 08 that certain people here claimed Obama wasnt eligible because his mothers age, something stupid like she had not reached age of majority for long enough to be "legal".
The outcry went on for months and years, we still have people who think hes a kenyan.
Notice Trump still wont bring out his truth about the "birth certificate that his "team found" Arpaio never had any luck either did they, it didnt stop them.
POOR Babies,

No matter the "facts" For Cruz it will be found without standing
But im loving the expected knee jerks.

Cruz wasnt born on US soil...unavoidable fact.

Seeing as his brother in law was convicted as a major cocaine trafficker, she's biding her time.

ETA. You are correct on one thing. Neither of his parents were citizens. Were it not for the special coddling that Cuban immigrants receive, he'd be a classic "Anchor Baby".

But his mother was a US citizen, also and undeniable fact, this, by law, makes him a natural born citizen.

Not surprising at all. It's a little funny, but mostly sad and ridiculous.

Wasn't it already determined that had Obama been born in Nigeria, he'd still be considered a "natural born citizen" of the US because his mother was a US Citizen?

I expect this lawsuit (and any others that pop up) to be as successful (for the same reasons) as the ones against candidate Obama.

Yes but the suit has much more merit since he is a Republican.

The suit has much more merit because there may not have been a certificate of citizenship filed by his mother. Until that is discovered, he is pure Canuck.

And Obama was born in Hawaii, not Kenya.

So, you have a born American Citizen according to law, Barack Obama.
You have a born Canuck who is not an American Citizen according to law, Rafael Cruz.

But it dont matter, the nutsucker is one of the many unelectable nutsuckers who wont be elected.
