US Supreme Court approves new rule expanding FBI's hacking powers

The US Supreme Court has approved making changes to a rule that will essentially expand the FBI's hacking powers across the country. The changes would allow the Department of Justice to secure warrants for remotely located electronic devices.

The changes, approved on 28 April, will amend Rule 41, essentially providing judges with the authority to grant warrants to remotely access suspects' computers, even when it is located outside their jurisdiction. In other words, a judge in New York would be allowed to issue a warrant authorising hacking into a suspect's computer or phone in any other state.

"Under the proposed rules, the government would now be able to obtain a single warrant to access and search thousands or millions of computers at once; and the vast majority of the affected computers would belong to the victims, not the perpetrators, of a cybercrime," said Oregon Senator Ron Wyden.

The Bloomberg reported Peter Carr, spokesperson for the Justice Department, as saying: "The use of remote searches is often the only mechanism available to law enforcement to identify and apprehend."

The ruling has caused widespread concern among privacy activists, who claim implementing such a law would severely infringe on citizens privacy and may even give the FBI the powers to administer mass hacks.

The ruling comes on the heels of the encryption controversy, with the recent battle between Apple and the FBI adding fuel to it. Apple's victory resulted in the FBI having to employ a third party, which it is believed to have paid over $1m to hack into the San Bernardino killer's iPhone 5C. It is likely that the Justice Department's push to make changes in Rule 41 was born out of the FBI's very real need to gain more power in cybersecurity investigations.

The US Congress now has time till 1 December to either reject or modify the changes to Rule 41, after which it will officially go into effect.

In all honesty, it was only a matter of time. There is an alarming trend of increasing fascization in most western nations, where the "needs" of the state are trumping the rights of the people.

never however could have I imagined they would jump on the fast track like they are. its a never ending ordeal and becoming a full time job fighting off the gubmints continual pushing for more power in violation of our rights.

look at all the state cameras we have everywhere in addition to this. can it be much different living in a 'free range' prison?

I think that in the case of the actual hacking, they have had the ability for some time. However, like the tapes of John Gotti they never used, could only be used for the investigation. Remember they had to get people to roll over on him to convict the teflon Dom.

This legitimizes it though so the evidence can actually be used in court. They have already ruled that the police do not have to reveal their sources. (but journalists do) This is supposedly to protect informants, but now really it protects them from having to reveal how much they do intrude on people's privacy.

Personally, I think people who want to do anything illegal or possibly against the government should be smart enough not to put the information on a smartphone, (remember that recent Apple debacle) or a computer. But people are stoooopid. The FBI regularly goads people into terrorist acts, playing the rebel or Muslim or whatever, and getting dumb kids to plant the fake bombs they provided and once they press the button it is as if they really did it. I wish they would try that with me. You can fool some of the people but...

Smart terrorists are still going to get away with it, and their numbers are greatly exaggerated. I believe since the year 2000 there have been maybe a dozen. Lessee, 11 hijackers right ? Boston Marathon, how many ? And don't even count the people who shot up military bases, they were their people so they were supposed to control them. Expel them and take away their gun rights. They propose to be able to tell who should have a gun or not out in the population when they can't even figure it out in their own military ? And cops, who kill more than anyone, but need 41 rounds for a guy with a knife ? And remember after the Chris Dorner incident ? People had shirts on said "DON'T SHOOT I AM NOT CHRIS DORNER" because they went after the wrong people. And they want OUR guns ? And don't gimme this "shit happens" shit, they have a license to kill so they must be held to a higher standard.

Anyone can read this post, including the FBI or No Such Agency and get a court order to get this site to give up my real email address and then force my email provider to give up my identity. You never had any privacy.

If you want privacy use snail mail, but you know if you are a target the post office will Xray your mail. You are flagged and your mail goes into a different bin. I shit you not.

So now it is across state lines, big deal. Jurisdiction was never determined wholly by lines on a map. just aks the legal scholar Obama about the US being able, by EO, to confiscate the assets of people in Yemen who go against the US approved Yemeni government. Where it is legal to marry an eight year old girl and kill her by coitus.

With Obama's "understanding" of the Constitution, though I think the republicans are scum, I think when they said they would not approve anyone he appoints, are at that point actually doing their job. When they kept on voting to overturn the ACA they were the biggest assholes in the world, and in fact are now. They are doing the right thing now, but for the wrong reasons.

I remember a book called "Infernoland" which was loosely based on Dantes' "Inferno". In it they had two politicians who opposed each other and every time they opened their mouth shit came out. The guy asks his guide devil or whatever "How can they both be here ?" to which the guide replied "They both thought they were wrong".

Too bad hell is just a fantasy, there are so many people who belong in it.
