Equal protection under the law does not mean equal rights to welfare under the law. The law says that one can not discriminate on the basis of race, creed color religion etc. Immigration status is not one of those protected classes.

A necessary compromise to bring the southern colonies into the Union following the Revolution. Not to forget that Jefferson and Madison were Virginians. But then a war was fought over the issue and up to 800,000 lives were lost. The 13th & 14th Amendment were meant to rectify the original flaw. Unfortunately, the racist spirit never died in the hearts of the populace.
