What made my jaw drop and eyes roll was the judge's tender concern that prison might have "a severe impact" on the convicted rapist.

Isn't a sentence for sexual assault supposed to have a severe impact?!

Ok you are smarter than the judge.

It's exactly things like this where I want to know if the judge personal opinion has clouded his judgement. In this case, is he fundamental christian? I mean, some fundies would blame the woman. The craziest part is, they got 2 witnesses, who witnessed it live happening, who rescued the woman. This case has more clear cut evidence than many other rape cases out there.

And live witnesses, him assaulting the woman while she is certified unconscious. She was still unconscious when brought to the hospital. It's like, she's got perfect evidence. Leaving no doubt at all that she has been sexually assaulted.

I heard people get longer sentences for taking or possessing drugs. Like this is seriously the most clear case of this judge has allowed his personal bias to affect him from giving a fair verdict.

And I don't know why Obama is so quiet on this shit!

Okay, again, I come from a different country, but if something like this happen and there was public outrage, the PM would address the issue. People will probably write to him to ask him to do or say something anyway! To demand a retrial! A different judge! And they would respond about what is the proper procedure for the victim to get a retrial and they will see a different judge be put in. I really hope to see people's movement change something in this case.

People's movement always create changes in my country. But our government listens more to us, they like to hear the "grumbles" in the ground, and every year, with policy changes, we see they meet us in the middle on some things where possible.

The petition for this case is nearly reaching a Million if not already reached. What is terrible is, the boy is appealing his 6 months to be changed to 4 months. How come the victim side isn't appealing that the sentence is not long enough? Or is that not possible? I don't know the legalities.

All of the fundies I know might disaprove of something she was doing, how did she get unconsious. On the other hand they would throw the book at him.

There is a question about his judgement? He clearly has none to speak of.

You imply this is unwanted, I imply he should die. Are we right on this ?

T^T

I'm not exactly gracious about perpetrators of sexual assault. I'm not going to sit here and say that makes me a great human being, so let's take me out of it and go back to discussing this case.

Now, I don't blame dear, ole Da for preparing his (sentencing) statement with hopes of leniency in mind. Nobody *wants* to see their kid go up for hard time. Prison is a hell of a lot worse than county.

Supposedly, statements prior to sentencing are to be used by the court to assist in the determination of how best to handle the verdict. A lot of people don't really know how sentencing works in our justice system

In my opinion, this six month sentencing for a conviction of THREE felonies is a travesty of justice. I hope the good folks of Palo Alto remove him from the bench.
