Never heard of it - had to look it up. Firstly, it was in the late 80's and apparently the clincher was that because the activities were not carried out within the private confines of the marital home AND it had been videotaped, made Article 8 protection null and void. So in essence, it was a 'special case' of S&M where physical harm was done and made available beyond the confines of a marital home; even though it was (allegedly) with consent by all involved. What they are basically saying is that it is not legal to do this shit outside of a marital home by more than just the couple involved and also to make it available to others. The house of lords stated that physical harm is not something that can be consented to in this type of scenario. I disagree that we are living in a 'hellfire and brimstone' era. We tend to be much more liberal and free-thinking than our American cousins over the pond. For instance, being "outed" wouldn't normally get you fired or get your benefits curtailed in any way. There may be odd instances like this case that come to light, but it's not so much "shock, horror" as the Americans seem to suffer.
