Accountability in Govt Regulations by Agencies to Congress

Should, in your opinion, this proceed or should Government agencies and departments be allowed to continue to pass regulations (no regard to political affiliation to POTUS) without congressional approval? I say it should pass.

Yes, they should as congress is mostly nutsuckers, and retards and are way to busy naming post offices after st. wrinklemeat, something they are also barely qualified to do.

Congress passes laws.
Departments form regulations in order to implement the laws passed by Congress.


If Congress objects to how the regulations are written; they have two choices:
A> Talk to the boss of the departments and ask for changes. (Call the Prez as the Departments work for him)
B> Amend the law to make it more clear what Congress wants so the various Departments don't have to try and figure out, in specifics, what the law means.

Regulations that affect the general population usually, but aren't universally required to, have public comment periods where objections and interpretations are requested. That is one reason it takes so long to change regulations implementing laws. Yep, the people running the departments often have their own agenda in how they word and interpret regulations.

If you need to object to regulations; it may be time to, as Warren Zevon put it, "Send Lawyers, Guns, and Money". You can always request a R.O.D. from any department but you may have to force them to act in a timely manner. (Record of Decision - once it is on paper; you can fight it on several grounds and in the courts... see the part of the 1st amendment canonizing the right to petition for redress of grievances. )

I suspect passage would be an unconstitutional usurpation of the powers of the Executive, a breech of the Separation of Powers, and a burden on the Congressional Agenda.

I think it is more about setting limits on how much it can cost without congressional interference than an attempt to stop regulations. The limit set is designed to have the agency report to congress before implementation as opposed to the after the fact review system they use now. Under the current system, congress can roll back the regulation. I don't see it as a constitutional issue. I can see where you are coming from and gave it consideration.

I see it as an interference in the executive branch, they already set the cost. If they make a bad law they can repeal it and replace it.
