ERISA does not apply to organizations operated by or associated with churches Case turned on the language of the law instead of protecting workers or health care costs.

https://www.statista.com/statistics/203003/number-of-hospitals-in-the-us-by-ownership-type/

Not for profit hospitals outnumber government hospitals 3-1 and for profit with the same stat. Although the chart does not specifically give a figure for religious based hospitals, I suspect the vast majority of not for profit hospitals are religiously based.

I read about this in the morning paper (Chicago Tribune) today.
It seems to me that if a religious organization starts an "affiliated business" with 100's (or even 1000's) of employees, administering the wages and benefits (in this case, pensions) for those employees should be subject to existing Federal/state laws, regardless of the employer's religious orientation.
If you hire a custodian/handyman to service your church and its grounds, fine. Do whatever.
But when you hire 100's of people (of all faiths) to work in a business that the church owns and these employees are not actual members of its religious congregation, then I don't see where an exemption from ERISA should apply.

I would agree that a law change might be in order here. The alternative would be for more for-profit and governmental hospitals at a more economic rate for healthcare coverage. The final option would be to force religious hospitals out of business completely by determining that they are blight or some other legal excuse.
