MrRodgers -> Justice Kennedy rumored to retire today. (6/26/2017 7:43:13 AM)

Will this skew the court more to the right ? Wasn't Kennedy as liable to rule with the left of the court...as the right ?

Let's not fool ourselves still. Judges are nominated for their right of left views and to vote a certain way on issues important to the admin. nominating them. In fact that is the very basis for not even considering Harland...nominated by Obama.

What say you ?

One problem I've had with this court given the idea that [it] is not to be 'activist' as observers continually harp. Bullshit, the appts. and the hope is by those who nominate judges, to get the partisan decisions they seek.

Hence not only on Citizens we got this:

The new majority opinion transformed Citizens United into a vehicle for rewriting decades of constitutional law in a case where the lawyer had not even raised those issues. I.e., not on point and as activist as anyone could imagine...to change the very basis of the court's consideration.

But we also get this and from Kennedy:

.....a zealous supporter of forced arbitration, a practice that allows corporations to force their workers and consumers into a privatized arbitration system that overwhelmingly favors corporate parties. He cast the key vote against Lilly Ledbetter and against equal pay for many women in the workplace. He cast the key fifth vote empowering corporations to immunize themselves from consumer class actions. And, of course, he also voted to install install George W. Bush as president.

Although such expenditures could ingratiate a corporation with and lead to greater access to a candidate, “ingratiation and access…are not corruption.” (Clinton's 'renting' out the Lincoln bedroom was then...not corruption) (H. Clinton's 1 of 9 votes to allow the uranium sale to Russia...was not corruption)

In fact “ingratiation and access…..” is the very basis of corruption. Ingratiation and access is the first step in bribery and need not even extend to paying for votes.

In some cases, a new judge couldn't be any worse. Not only is property not speech but the corporation is as Madison contended...an artificial or even alien association, never to be attributed with rights of the people.

Kennedy will 81 next term.

What say you ?

The SC has too much power. It was designed for a time when men were educated and honorable, and politics were guided by intellectualism rather than emotionalism, and at that time and for a long time afterward the Supreme Court functioned as planned

Today the invented Marxist ideology, destroyer of worlds and enslaver of mankind has taken over too much of society for the SC to function as designed. If Marxist radicals manage to take over the bench they will rule over us as gods, and that is what is at stake because leftist presidents anoint robed Dear Leader dictators to the bench who recognize no laws and no boundaries and the only thing that matters to them is furthering that murderous, all-corrupting ideology

Anyone who interprets the constitution and the laws as written and intended is branded a "right wing extremist" and a "racist" etc, and the propaganda comes from every corner against conservative speech, second amendment rights, and so on.

We have seen how leftist judges eagerly hobble any non-Marxist president, effectively nullifying elections. Imagine that kind of problem on steroids if Marxists ever manage to seat a majority of alt left radicals like Ginsburg, Sotomayor, Kagan and Breyer onto the Supreme Court bench. Total societal breakdown will ensue, with civil war following as one right after another is stripped away to make way for Stalinist "progressivism"

Raw emotionalism, with no basis in reality.

It has only the power that john marshall and the constitution give it.
Jesus you are phoquing stupid.

You do not seem to know much about the history of amerika.
Nothing in the constitution authorizes judicial review. The court has been used in the same manner for more than 200 years.
Jesus you are phoquing stupid.

And in other court news, Trumps travel policy is reinstated.

The court made an important exception: It said the ban “may not be enforced against foreign nationals who have a credible claim of a bona fide relationship with a person or entity in the United States.”

In the unsigned opinion, the court said that a foreign national who wants to visit or live with a family member would have such a relationship, and so would students from the designated countries Libya, Iran, Somalia, Sudan, Syria and Yemen — who were admitted to a U.S. university.

The court said it would hear the case when it reconvenes in October. But it also indicated in the ruling that things may change dramatically by then. It asked the parties to address whether the case would be moot by the time it hears it; the ban is supposed to be a temporary one while the government reviews its vetting procedures.

Let me know when it's actually news.

Sorry. Something might happen isn't news.

When it happens, it's news.

That something is happening in the meantime, news. But this was non-news from the moment they uttered it.

If he resigns tomorrow, then it's news.
