Courts today are skeptical of affirmative action as a remedy for past discrimination. Under both the Constitution's equal protection guarantee and Title VII of the Civil Rights Act of 1964, distinctions based on race are inherently suspect, whether such distinctions are burdensome as in the case of traditional discrimination or "benign" as in the case of affirmative action. Under the Constitution courts must subject affirmative action programs to strict scrutiny. Accordingly, such programs cannot pass constitutional muster unless they serve a compelling interest and are narrowly tailored so that the identified interest is served with the least harm to those who have not suffered discrimination. If it's so illegal, why are media outlets banning white people from applying for internships? Explain that.

If they are indeed "banning" white people from applying that would be unlawful, unless there is a specific reason like a black actor playing a black role, a GP surgery requiring a female GP for patient choice, requiring female workers to deal with female victims of abuse (or vice versa) The link Peon shared is excellent and provides other links further exploring the issue. Without knowing or understanding the overall recruitment strategy of these companies it is difficult to judge but it may well be illegal. The Personnel Today link however is a good starting point however for exploring a balanced view of how this works in the UK, rather than just concentrating your Westmonster link which provides a juicy headline but contains very little background information.

In Australia, it is illegal to discriminate on the basis of race gender and sexuality, unless there is a specific legal exemption. The most common exemption is the religious one, granted to churches to allow them to preach for example that homosexuality is sinful, which would otherwise qualify as hate speech. Affirmative action programs are activated only if there is no other basis for distinguishing between parties. So for example in a job vacancy situation, the best qualified candidate always gets the position. In the rare event of there being two candidates with precisely equal qualifications experience and suitability then affirmative action programs come into consideration and the position is allocated on that basis. It is rare for AA to be the deciding factor in these situations. These provisions are often utilised by churches to ensure that jobs are only given to adherents of that particular faith. There are some situations where discrimination can be made after an application to the relevant Anti-Discrimination Board. For example, a position of community organiser for the Aboriginal community, can be reserved for Aborigines only after a successful application. It should be stressed that the presumption is against granting the exemption, and the applicant has to prove their case convincingly. In effect, this means that approval is withheld unless the applicant can convincingly demonstrate overwhelming need. So these cases are also relatively uncommon. It is interesting that the opposition to AA programs most often comes from racists/male supremacists/homophobes etc and those who have historically opposed all measures to bring about racial/gender/sexual equality. Rm with his long and tedious history of racism, misogyny and Islamophobia is a perfect illustration of this point. It would be naive to believe for an instant that such people are interested in genuine equality - their agenda is precisely the opposite.

I keep thinking that he might actually do some reading into the subjects he posts about but it seems a forlorn hope. Despite the central commonality that people of colour have in general not achieved equal treatment in western societies, there are certainly some differences between the US, UK, European and Australian experiences. However I suspect the OP does not have the sophistication to discern those, especially as he fails to see that white men are remain significantly more advantaged that other groups, holding most of the wealth and political power. He trawls the media for headlines he likes without bothering to understand the background to what he posts. There's none so blind as those who will not see.

He probably has a better idea who Phillip Davies is than most on here, sadly. It may not come as a surprise that the guy whining about oppression of white guys in the OP is famous for blocking legislation that tries to correct imbalances against women (in particular) minorities or the disable when he can manage to drag his carcass into the common to derail a reading.
