The nurse in a Utah hospital was simply following protocol. The police officer wanted blood from one of the patients who was suspected of committing a crime, maybe drunk driving. The nurse very calmly explained to him that she can only give him the blood if he had an electronic warrant, or the patient consented, or the patient were under arrest. The police officer became impatient and forcibly arrested the female nurse. Pissy police training in Utah or an idiot cop more probably?

Status: offline 		Can't speak for Utah, but here in MI if someone is suspected of DUI and refuses a breathalyzer test, then a blood test becomes mandatory by law, no warrant or consent required. So if that happened here the nurse would have been obstructing justice, or impeding an officer from performing his/her duties.

Well...on the bright side, at least he didn't shoot her and then claim self-defense.

It's not like the officer involved was some rook. It was a fucking Detective. Yaknow, one of the guys who has been around long enough to advance.

I know they have promised 'retraining' but seriously. That's just a paid day in the conference room with all the coffee and donuts you can scarf.

The cop admitted that none of the criteria needed to get the blood drawn was present. But he arrested her anyway.

He was being a dick. Purposely.

my first thought when I saw the post was to wonder what the actual law was in Utah, not hospital policy, but the law.

they may be the same, they may be different. itd be good to know.

its possible the cop didn't know the law and yes, saw the nurse as "obstructing justice."

Status: offline 		Just saw this covered on ABC news. The nurse refused because of "hospital policy." It really would be nice if they had checked Utah law for such situations. The guy they wanted to blood test had caused a fatal crash.
