So, I know the whole O'Reilly thing is a dead horse by now, but this is interesting.

This JUST came out. In addition to the other lawsuits we knew about, O'Reilly settled a lawsuit for $32 Million RIGHT before Fox renewed his contract.

Without going too much about O'Reilly (except in this case he was sending her Gay porn????)...

I can almost agree with Fox's decision. He was the highest rated cable news host, EVER, and a cash cow. I said ALMOST :)

In light of this though, I can see Fox in jeopardy of severe civil liability for the foreseeable future. They clearly KNEW the severity of the allegations, and KNEW he settled a lawsuit for $32 Million, and renewed his contract anyway.

I'd hate to be the Director of HR at Fox.

I realise something.

"Sending gay porn" to antagonise someone is apparently "sexual harassment" too.

I feel like most of O'Reilly harassment, involve him being the asshole he is.

Just that, with men, you can insult them all you want.

But with women, if you antagonise them with female-related stuffs, that outrages them.

It falls under sexual harrassment.

I don't think O Reilly has actually sexually assaulted a woman.

Basically the problem with him is. He cannot control his temper. He fucks up. And then wanna solve it by money. He basically offends women with his words.

I mean paying a woman 35mil for sending her gay porn? WTF?

If you even think about a man sending a woman gay porn. That's seriously just to antagonise her on purpose.

I do not think this lawsuit alleges that he sexually assaulted anyone. I think he just created a very uncomfortable environment for an employee. Yes, to your point, women can be considered to be "harassed" by society and the law much easier than men can be.

Also, to your point, billo is an immature asshole.

It can be sexual harassment to a male, too. Any sort of unwanted sexual advance or sex-related exposure can be sexual harassment. If I were to tell a sex-related joke to a male colleague and a female walking by overheard it, I could be reprimanded by my employer for sexual harassment by that female. Men can be accused of sexual harassment by other men with accusations of homosexuality.

The key is the "unwanted" part.

And the rest of the story... The incident was used as an excuse to get rid of a problem employee who had exhibited several lapses of judgement. This was claimed to be the final straw. And when he took it to court, he ended up winning several million dollars from the company over it.

So it did not stand as sexual harassment and the guy got enough money from them to equal more than 260 years of employment.. But who cares about facts.

As an example of a sexual harassment claim, it was misleading and ultimately proven to be nonsense. The company paid out over 26 million dollars for their stupidity in trying to justify it as sexual harrassment.

You're right. It certainly didn't address my point so, I don't understand (entirely) why my words were quoted.

My point was/is: there's a group of people that wish to silence all who don't agree with them and will use any means necessary.

I get your point about miller's argument being the guy was fired for reasons other than just the alleged sexual harassment but given the timing of the firing and being as the latter was a part of the rationale, the reason for the trial, and the crux of where the jury award came from, that, the jury's rejection of the claim are not really consequential to the posters' point---which was, that sexual harassment charges have a chilling effect on people in the workplace.

as to the award, the bottom of your article states the appellate court overturned that aspect of the case. so the guy, apparently, ended up with nothing. although i'll confess the legalese is tough to understand.


off in a related direction, I agree that women can and do have a civilizing effect on men but at the same time, one wonders if there is room for "boys will be boys?"

by the way, did anyone notice in the nytimes article in the op, the phrase (concerning o'reilly and the plaintiff) that a "non-consensual sexual relationship" was going on? am I remembering that rightly?

ok... Back to the topic...

It turns out that Fox put a clause in Billo's renewal contract that if any more information surfaced or was about to surface of the settlement, Fox would terminate him.

They got word that the NYT was working on the story and terminated him.

OK.... before, I was ALMOST ready to give FOX the benefit of the doubt. But this is just twisted. No concern for the safety or environment of its employees. It is 100% about the word not getting out. Yes I suppose I already knew that, but this contract clause thing is sick.

That's pretty good! She didn't get sexually assaulted. She didn't get rape.

Just for receiving gay porn. She earned 35Mil for keeping her mouth shut!

Wow! I'd be finding opportunities for Bill to be sending me gay porn. I want my 35Mil too!

Bill is seriously stupid. I can see that he is the type of person who makes rash decisions under his temperament.

And it's unfair jaguar to say that Fox was not creating a safe work place.

Bill does not sexual assault women. He is just someone who is nasty with words. There are plenty of high ranking bosses that are nasty with words. And Fox was simply saying to Bill, control that temper of his, one more incident and he is OUT.

I think in the US, like if Gordon Ramsey did what he did, put two slices of sandwich on a woman's head and call her an idiot sandwich. That would be sexual assault technically. If that woman bothered to sue Gordon, she could get 35Mil too.
