Right, so you agree the majority of the people in Afghanistan who were arrested (including Takiban) were covered under Article 4, section A, nos. 2, 3, and 6. And even if they weren't Article 5 of the convention gives them all full protection until such a time as a competent tribunal can be formed. (This is similar to that innocent till proven guilty thing America had until the Twin Towers incident).
And all of us contributing to this conversation know why nearly all people detained in Iraq today have the same rights - that couldn't be spelt out more clearly in the Convention.
