Cassel: If the President deems that he’s got to torture somebody, including by crushing the testicles of the person’s child, there is no law that can stop him?
Yoo: No treaty.
Cassel: Also no law by Congress. That is what you wrote in the August 2002 memo.
Yoo: I think it depends on why the President thinks he needs to do that.

How can Bush now claim the moral high ground as compared to the average Islamic terrorist or South American drug-lord? The "alleged criminal" sure can limbo down, huh? How low can he go?

...i keep saying it, and no doubt will say it again..........but if you want to be seen as having the moral high ground, you actually have to occupy that moral high ground.

Ah, the silence of the right wing...the silence of the bloodthirsty hypocrites...

Is the argument too subtle?

Philosophy, who wants to be seen as having some imagined "Moral High Ground"?
And for what purpose? To "impress" the likes of al qeada? The illusive "World" opinion?
Your whole premise is wrong.
And who decides what's "moral" or not "moral?"
I think other countries "want" the U.S. to be more "moral" so that they can more easily manipulate us.
I  certainly don't want any religion  in my govt. nor do I care if they are particularly "moral" in my govt. (Bill Clinton fit that bill, didn't he?)  I just want my govt. to work the way it's supposed to work.
We hear about "Human Rights" a lot but where are the "Human Rights" of American Citizens not to have our country invaded by illegal aliens?

...if you think the human right of an American not to have a bunch of illegal aliens around outweighs the human right of an individual not to be tortured then we have to have a chat about what the word 'human' means. Popeye, do you really think American first, human second? That Americans must have all their rights granted them but foreigners are less important on an absolute scale? Most of us, if put in some hypothetical situation where we had to choose between saving the life of a 30 year old American and a 4 year old Somali, (all things being equal) would save the kid. Sometimes Popeye, i think you'd save the 30 year old.........
