BDSM and Laws in Virgina (Full Version)

Hello,A/all.  My and my Kaj are looking to move to Virgina. Now, we've heard some disturbing things about sex and the law there. So, what I would like to ask the denizens of the board who live in Va; What is the climate there like for those of us who practice this lifestyle, and like our S&M play? Is it a place that is safe for us, or do they actively enforce these draconian laws? Do they invade the privacy of the public? we do love the mountains and such in Virginia, but ought we consider going somewhere else to live?

On a related note, how do they asses the personal property taxes? Do they come in and go thru your house to asses it, or what? I mean, would I have to hide the BDSM gear and such?

I don't live in Virginia, but I spend a fair amount of time there: it's always been one of my favorite states.  I think you will find that it varies a lot in different parts of the state.  Whether the state is repressive or not depends on where you are coming from. 

My experience with the South (I've lived here all my life except a couple of years in Asia, compliments of the US Army) is that it is generally very conservative on the surface, but liberal underneath.  It's not at all unusual for people to vote to outlaw things they do on a regular basis, and everyone understands that the laws won't be enforced much- the fact that they are there at all acts as something of a deterrent.

Trust me, Black Rose is at least 50% made up of Virginia citizens and there are regular munches and parties there in the state itself ALL the time. 

Now, if someone decided to crawl up your ass about it, I'm not sure what would happen, but the chances of that happening if you keep your nose clean in general is pretty darn low.

And I can't help you on the taxes stuff- though I can't imagine having to hide your stuff.

I am not sure about the sex laws in Virginia.  As far as the personal property taxes they tax you on your vehicles, land and building.  They do not come in to your home to assess any other property.  Good luck in your move!

My sub lives in Virginia and I go over there alot. It has its conservative/religious/family oriented areas and its more open cities. I would say as a whole I wouldn't go around walking my sub/slave on a leash  in public, but I also wouldn't worry about the cops breaking down my door either as long as you are discreet.

With that said I googled Virginia State Laws and found this on one of the sites:

"Virginia still has many sex laws. Many have gone unenforced for many years while others are stricly enforced regularly. It is important to know the laws of your state. Virginia is one of the more conservative states in the union when it come to its sex laws. We were one of the last States in the union to legalize marriage between mixed races."

Don't flaunt it and you won't have a problem. However, if she misbehaves and you discipline her physically in public you will probably have problems. Virginia, the parts I come from anyway, are made of good ol' southern men. That means if they see you strike a lady, they will not hestiate to beat you down or at least call the cops on you. I love them for it because it makes a woman feel safe when venturing around. You don't need to be paranoid about it, just be aware of what the public can see. Which is good advice anyway since the public can't (and probably wouldn't) consent. *Grins*

i was born and raised in rural southern Virginia, lived there (with the exception of a year or 2 here and there) until my Master took me to live with him in Maryland. it's true, how conservative and how much your everyday life will be effected by the laws and conservative values depends on just where in VA you live. now if you're going to northern VA, the rest of the state doesn't even consider that part of Virginia...do what you want, it's very progressive, liberal, etc. but if you're going to be in central, western, or southern Virginia, you could have some things to think about.

Aquatic mentioned something about being "beat down" or having cops called on you if you're seen hitting a woman in public....i've found the opposite to be true. many times i've been "roughed up" by my Master or another man in public, and people tend to ignore it. there's a pretty strong attitude of strangers not interfering in the business of a man and his woman. now otoh, here in maryland we've had plenty of trouble/neg. attention from legal and medical authorities, because the attitude here regarding such things is much more politically correct and liberal. however when it comes to sexual things in Virginia....whole different story. even wearing a short skirt or a collar will get you plenty of nasty looks and comments, so outright sex in public might be difficult, but not impossible.

as far as personal property taxes, they don't go through your house for that, they only assess the value of your home, vehicle, and land. however some lifestyle acquaintances of ours who ran a BDSM bed and breakfast moved twice due to nosey neighbors, and are now in another more liberal state.

I dunno where you were living. Where I grew up, men got into big trouble for messing with their ladies in public.

We have many active BDSM groups here in VA, and I haven't ever had an issue with attending groups or practicing what I enjoy. 

As far as taxes, I pay real estate taxes and personal property taxes on my car, and my property has always been assessed without anyone coming into my house.

Sex is not allowed in Virginia.

Spelling the word "sex" however is allowed (so long as it's done fully clothed, and not in public).

not sure where you grew up either, tho i'm guessing the disparity could come from cultural differences which vary from area to area. you also referred to "good ol'" southern men, which i equate to mean redneck, as that's how the rednecks in my area referred to themselves (with pride). i worked very hard to avoid any association with the redneck types, so the inner workings of that culture may be very different from the things i've seen and experienced.

I live in VA, always have.  While Northern VA is a bit more liberal, there are still a lot of conservatives about, trust me.  In Northern VA, I would defy you to strike a woman in public and not think that the cops will be there faster than you can draw back for a second swing.  Anything perceived as domestic violence in public can get you hauled off in front of the magistrate because VA is a state where a domestic violence call (almost always) means that one party will be arrested or removed from the residence  for up to 72 hours and an emergency hearing may be included, even if the parties do not want to press charges.  Basically, if you are going to "play," play smart and be discreet. 

There are lots of munch groups that meet in and around Northern and central VA and lots of nice folks who belong to The Crucible, BESS, Black Rose or who go to The Playhouse in MD. 

Assessments, as have been mentioned before, are done on personal and real property.  Assessors do not come into your house or what-have-you to do an assessment.  If you are planning on moving to Northern VA, get ready for sticker shock as far as taxes are concerned.

I've lived in VA since I was 3 yrs old - Richmond area (center part of the state).

The most liberal parts of the state are deep within the bigger cities - Norfolk, Charlottesville, Richmond, DC area, etc.  Each of these areas have munches and groups.  I understand Salem has a BDSM group though, as well.

Yes, the state is otherwise extremely conservative.  Co-habitation is still outlawed here - there is no "common law" marriage.  I understand the co-habitation law is ignored UNLESS the police are looking for something else and can't find it - then they slap you with this one.

Re: personal property - they tax your house, car, boat, property (land), etc, but nothing else - <grin> no searches of your property, etc. that I've ever heard of.  Most of the taxes are figured based on sales documents.

If you have any other questions or would like info or a tour someday, let me know - I love the state, as conservative as it is.....it's truly beautiful.

(An aside - did you know the phrase "Virginia is for Lovers" didn't orginally mean lovers as in 2 people?  It was orginally intended to mean:  "Virginia is for Lovers OF: mountains/beaches, cities/countryside, history/technology, etc." - because of all our beautiful contrasts.)

In ten years, I have never heard of a case where this was ever an issue.  It's archaic and is only even looked at in the event of a minor is being subject to the blatent sexual activity of one parent and that parent's paramour.  Even though adultery is prohibited, the level of proof is Strict proof thereof, meaning you gotta pretty much catch your spouse in the act.  An overnight stay of a lover does not mean that sexual activity occured, that does not equate to strict proof.  So while VA has some old laws, they are pretty much left alone most of the time unless there's proof that a crime has been committed otherwise.

I discovered, growing up in an area that was both rural and close to DC and Richmond, that there is a huge difference between a southern gentleman who respects and protects women while getting a farmer's tan and working for a living and a coarse redneck who attempts to grab my ass and thinks my bisexuality is just an excuse for him to watch two women going at it.

Give me a southern man or a mountain man any day. They'll defend and love you to their last breath, along making you their personal little whore. As long as you ask nicely.

Newdombbw, thank you for the offer. May have to take you up on that. We are looking at Charlottesville. Not up in my mountains, but the schools there seem to be exceptional, and it seems to be very highly rated in the list of best places to live consitiently.

I'm not terribly concerned about public incidents. We don't have public sex (I think you could only get away with that in california...lol), and I always make my collars to be jewelry in and of themselves (ok, not fine jewelry...lol), so they could be worn even by non-BDSM types.

I'm certainly glad to hear they don't come in to asses taxes. I would reallly think the gov;'t knowing what I own would violate sooooo many constitutional rights.

Dang, you are making Virginia sound like Iran or something. You know I've lived all over this country from CA to PA to TX to GA and many places in between, including Wash. D.C.and have found them all about the same as far as police and being kink friendly. People are people.

That tax thing you are worried about may be something called a value added tax, VAT. Technically, many counties have a tax on high value items you own such as jewelry, etc. Does anyone pay this? Hell, no. No one is going to come checking in your house for anything without a warrant for a suspected crime.
