My own solution is to divorce the religious ceremony from the "civil benefits ". Make everyone get civil union permit, from which all benefits like property rights, medical rights parental rights etc would flow. Let marriage revert to a religious ceremony that has no value in court.  Be really progressive and make couples renew it every 4 or 5 years, lol
This way gay/ straight marriage becomes a moot issue.

you must prove you're able to have kids before getting married - so are the state is advocating sex before marriage now? it would only take one lawsuit to make it national and international news ...i wonder how the Supreme Court Justices would vote on an issue like this - is it constitutional for a state to require some sort proof that a couple is able to bare children within 3 yrs of marriage?

I like the idea behind it. I'm sick of same-sex marriage being attacked. Marriage at the institutional level is a joke anymore anyway.

I personally may be sterile due to a medical condition... I don't care if that would prohibit me from a "legal binding marriage"

If I ever get married it is going to be a spiritual union. I don't give a shit what state recognizes it.

My solution is not to get married. I've never seen the attraction in opening up your private life to public ceremony. I find weddings even more illogical - spending a fortune on blessings, hats, buffets, dresses and very dubious discos at the end of the evening (topped off with "I will always love you" last record of the night). It smacks of attention seeking.........."look at me, I'm married".....18 months later "look at me, I'm divorced" (tongue in cheek before the angry married types herd this way) How many solid relationships go down the swanny after marriage? Why do it if it's not broken?

I say keep your private life private, make your own private commitments and save yourself a few quid which you could spend on a nice, long holiday abroad.

On a brighter note, I have been to weddings where the bride came dancing down the aisle to some music or another....was quite entertaining.

The idea behind this initiative is to point out how stupid current laws are that are already enacted.  I think it is brilliant.  If this bill and several others get shot down as unconstitutional, then the Supreme Court will be forced to rule the current law as unconstitutional.

If I remeber correctly, as recently as the last centery some churchs forbid marriage if one or both were know to be unable to procreate. War ingury or such.

Things to think about though... without a legally binding marriage in the instance that the person you are "spiritually" bound to is hospitalized for something serious enough to require another person to make the decisions you... not being legally married to said person... would have no decision making authority. That is left up to the "legal" next of kin. Been through that.. my sister was in a car accident, her boyfriend... they had been living together for a few years... was right there. She needed emergency surgery, her spleen had ruptured.. but he couldn't sign anything, they had to wait for her daughter to arrive.
 
Nor can you make arrangements for the body to be picked up in case of accidental death, and in such an incident if there are step children involved you also don't stand a snowballs chance in hell of keeping them even if you've been their "parent" most of their lives... it's all up to "legal" next of kin.
 
Without that little piece of paper you can be removed from your home that you shared with a passing significant other for decades... the list goes on and on... it's bull shit.
 
Fine, change the laws concerning marriage... but if that can't be done... then change the laws about the rights significant others have.

That is the way it currently is in Canada.  Of course homosexuals can legally wed in Canada as well.
