I like internet radio.  it is where i find my music and find out the new albums i want to buy because much like my sex life, my music is not mainstream. 

I wanted to show you all what was going on and see if you wanted to sign the patition to hopefully get that stupid royalties fee off the braudcasters.  maybe go to some of your favorate band sites and let them know what the recors companies are doing and will do to their record sales if this shuts down internet radio.


this also hurts the small internet radio stations and will put them out of busness.  my music may not be yrou music but this is gonna affect all music on a streaming band. 

read and do yrou part to keep these small radio stations streaming music.

Dude, this is a can of worms you might not be ready for. This is a longstanding fight, and to understand what is going on is to understand the RIAA etc., the music industry.

Record producers and agents, all the execs and all that may make more then the artists themselves, but the is because they make it off of many artists.

As such if you threaten revenues from any one part of what they normally collect for their service, they are sort of threatened on all fronts simultaneously. If they lose one they could lose it all.

The RIAA is the major opponent, the MPAA deals with movies. You said music. The RIAA is a typical business, and has gotten a measure of supremecy the American way, through acquisitions or mergers, or by letting some competitors join there "team". Nothing unusual here, and they are operating in their own best interest, and they interest of their stockholders.

They had the basic reverse class action "settlement" and induced an old Lady here and there to confess that they let their grandkids download music, promise to erase it alll and never do it again, but I'll never sign onto that. I already have my own defense planned and maybe it'll make case law.

I have contentions which are true and provable. They illustrate an offset, and in my case the offset might be bigger than the judgement they get from what I have downloaded. If just one case goes this way, and is not overtruned you will see changes.

I have an attic full of old LPs and CDs and 8 Tracks and cassettes, I have beta and VHS hifi tapes of concerts. The media is worn out, so I am countersuing for recompense based on that (NOT an offset, you can't win money with an offset). Oh no, even if I have to file a seperate case. If they win that one, it makes case law, which supports my case, they owe me replacements for all the times I paid $16 for an album it costs them less than a dollar to reproduce. I'll take it in MP3s, if necessary. But what I wouold like to do is come up with a few things they cannot replace.

Once blown out of the water like this, we should be OK. But the whole thing has to be gone through at least once. If a lawsuit actually costs them money, remember those sharholders. It is only logical to persue if you can win money.

There is alot more to this. Should I upload what I have so far for a response to such a suit ?

Like any other business, Music is now a business and not a charity. Artist are out for Fame, Glory, and Money. For centuries, music has fought its way to be apart of mainstream society as well as become a profitable career. Study your history. Musicians and Actors alike were once considered to be outcast and mere entertainers for the populace to mock and laugh about. Most of the time, these entertainers only worked for the scraps thrown at them by there viewers. Many laughed when DeVinci predicted "One day, man will fly" And so the same with Musicians becoming rich celebrites and calling the shots. Music has evolved into a hype that very few activites can compete with. When you love it, chances are there's a price to pay. After all, when someone has the opportunity to profit, they will stick it to you. These talented individuals want there cake and they want to eat it. That's Show Business.  Can you blame them?

The actions of the RIAA have NOTHING to do with the Artists.

They get fucked over too.

Steve Albini and ( gak ) Courtney Love have both done great essays deconstructing the financial deals.

And recent moves in the courts are defanging the RIAA's predatory litigation strategy.

I agree. They want to sue me when at least ½ of the music on my PC is by dead people ?

What I want to know is what happened to public domain. If this was in public domain before and now it isn't, where is my check ? I am part of the public.

This is an appropriation by the government, plain and simple to take something the People own (because the copyright ran out and they were dead), take it and somehow give or sell it to a private entity. How can Michael Jackson own the rights to Beatles' music that had been in the public domain ? Just who did he buy it from ? And in the end, where is my check.?

I remember the days when local bands sent tapes into local radio stations, now a bunch of suits decide what we hear and don't hear.They incast the whole body of new product with their own flavor at the very least, and some of them with their own agenda. Nother thread for that.

I'll work on my response to an RIAA attack some more this weekend. They will not mess with me twice, I don't want to get cocky, but I think it would be really cool if they actually won, but won an equitable settlement after a thorough audit, and it was found that they OWE ME. Even one dollar.
