Hi everybody,

Attention all professional mistresses !!!!

Can anybody tell me if domination is legal in America? I mean specifically New Hampshire. My girlfriend is thinking of trying out professional domination for tribute. She has many fetishes as I do and we both realise the need for helping others experience what they need, very important. I know when I grew up I couldnt talk about it and it took me years and years before the internet showed up to actually experience my fetishes.

If it is legal, when it comes time to pay Uncle Sam, what sort of business would we declare it as? I cant imagine telling the IRS that she is a professional mistress LOL!!

Any help and advice would be gratefully recieved.

If your serious about it, you should consult an attorney in New Hampshire, as each state has different laws regarding this sort of thing.

Most states you can search the laws on line. I'd start with the laws on prostitution. In Indiana if you touch anyones genitals in return for compensation of any sort, cash, tribute, gifts, favors, etc... then it's prostitution. http://www.nh.gov/government/laws.html might be a good start.

Then there are the laws that can get even the non-pro's in trouble and thats under assault, assault and battery, rape, etc...

Basically if a DA wants to get you, they will find a way. Remember you can't give someone consent to break the law and violate your person in anyway. IE you can't consent to letting someone shoot you or kill you. You get the idea.

Agreeing with MistressMelissa.

I strongly suggest you pay very very very close attention to zoning laws as well.

There is a pro in Indy whose had problems because she wants to claim her pro business isn't an adult business. I think its because she discovered herself in an area not zone for adult business. Maybe it changed after she had her business set up?

Regardless it is your responsiblity to find out about zoning laws, keep up to date on them and always respect them or you will find the cops at your door.

A couple of stops you should make before you open up shop:   A local lawyer who is familiar with adult laws in your specific area (not all are), an accountant, and you should also talk to local pros.

Expect that you're just not going to make a quick buck, and that you'll have to invest a LOT back into the business as you get started up.  Toys, costumes and equipment are expensive!

OP,

In short. NO

If your GF receives any monumentery ‘gifts’ or tribute for a ‘session, meeting etc” that, at the will of the court, can be labeled as solicitation or prostitution. As an extreme example that I can not recall the details of, I only read of it, a client at a strip club -legal, licensed, above the board- was choking his chicken, and THAT got the establishment in trouble. There are how ever ways around it. Your GF can get gifts and money and labor in advance and then for the few select slaves meet them.

Truthfully it would probably never come down to this as an argument in court as the cops (you’d be surprised how many cops pay pro’s to be spanked themselves) are really not interested in wasting time with a ma and pop home brothel unless the neighbors complain.

That also reminds me of another defense I read. Arrested for soliciting a prostitute who is really an undercover cop. Well then he did NOT solicit a prostitute, to his knowledge he saw a REALLY kinky off duty cop who was fantasying about being a whore. How was it his fault that he got caught up in her fantasy? Technically he did not solicit a prostitute, he solicited a cop, and even that was merely a fantasy he thought as she MUST be off duty as she is out of uniform and she offered first.
