I would imagine that the argument would be that Congress hasn't created the requirement for permits; the requirement is by local law.

It`s a great little example of democracy in action. Messy,loud, raucous,in your face and real and un-nerving to some. Skip`s right,unless it`s the save the bunnies or a cancer fundraiser you`re not getting a permit. I think they all knew that and still took the risk anyway, because of how strongly they feel. They are grass-roots obviously,not corporate funded like the tea-party and definitely didn`t get bused in from all over, on buses payed for by the Koch brothers.
