It is probably true in most cases that a particular list owner views the posting of ads as a free speech issue; and many list owners site free speech as a First Amendment right, as outlined in the US Consitution and the Bill of Rights, as their excuse for not monitoring their list in a responsible manner.  However, it is my opinion that failure to prevent exploitation, or turning a blind eye to it, equates to a blatent disregard for those who can and are regularly victimized.
