sleepy drivers are next. they will start with CDL drivers- then it will be voluntary- then it will be random roadblocks.  then you will forfeit your car if you drove while sleepy.

I use Bluetooth, so no.. I don't worry about being distracted. I do think it would be a great thing if extra fines were used when an accident is caused by driver distraction (eating, phone, kids, loose dogs etc) but it would be hard to prove.

The seatbelt law, for example.  I recall when it was first passed, you could not be pulled over for that reason alone.  I forget what it was called exactly, a 'b' class offense or something like that.  Anyway, once the public was accustomed to being told they have to wear a seat-belt for their own safety, the law was ammended (at least in the states I've lived in - can't speak for ALL of the states) to allow law enforcement officers to pull you over if they see you without one. 

Before I give the wrong impression.  I think children should ALWAYS be kept in car seats and properly restrained when in a vehicle, and laws should exist to assure the safety of children.   I just think that legislating our choices for us (as adults), we are whittling away at our personal freedoms. 

The difference I see between the seat-belt law and the law governing the use of cell-phones while driving, is that statistics have shown an increased probability of accidents when a person is distracted by the use of a cell phone.  Such actions put others at risk.  As an adult making a choice for herself, whether or not I wear my seat belt doesn't really harm anyone but myself.  Regardless, the point I was trying to make (and I hope it comes through clearly) is that once a law is on the books, even if it sounds reasonable, it opens the door for additional loss of liberties. 

I have conflicting issues here.  I think it is irresponsible to knowingly put other's at risk because you cannot take the time to pull over, and safely do your work, and conduct your business, or invest in a hands free device.  However, I cringe each time I see new laws slowly excising our liberties.

you are so right about  seatbelts!

I was thinking the same thing. they were at 1st a secondary offense, now they are not.

if is determined to pull you over- he can FIND an infraction.  One reason is the laws are written in a contradictory and vague way. So one cant possibly follow EVERY law- every inch of the way.

all the talk about profiling.  the college kids here are more likely to get pulled over then  a 40 year old. [a good reason not to have bumper stickers]

A bluetooth set up is even cheaper still.  I rarely talk without one, whether on the phone or not.  I like to keep the use of my hands for other things...

it's a city ordinance here and that $75 to $90 ticket does add up if the cops catch you driving while chatting on your cellphone.  however it's too sad we ordinary citizens cannot ticket city workers, cops, etc when catching them chatting on their phones while driving.

It would be funny if it wasn't so scary.  You could take all the cell phones away (or force people to buy Bluetooth), make sure no one is inordinately sleepy or eating or whathaveyou, and some drivers would still be menaces to society.  As someone earlier touched upon, you can be the best and most attentive driver on the road and that doesn't keep some idiot from pulling out in front of you or switching lanes without signaling or something else to cause an accident.  Some people definitely shouldn't be behind the wheel and I really don't think it usually has one thing to do with being on a phone.  They will legislate anything that we don't speak out and stand up against.  But many people appear more than willing to let everything be controlled and dictated, right down to exactly what one can do while driving.  Next thing you know, they'll be trying to outlaw getting a blowjob while driving.  Geesh.......................luci

There is NO fucking reason to be on the phone when you are driving..years ago, we didn't have cell phones and we lived lol...you get a call that is important, pull over onto the side of the road and take the call..don't PUT OTHER LIVES AT RISK FOR THE SAKE OF CHAT.

Look I ride so for me well all i have to say is the last thing i want is one more ditraction for the morons in cars on the roads....between the thumping music and there friends and just generally bad driving skills and lack of paying attention to the road.
last thing i need is the yuppie talking on the phone as he runs me the hell over.

Wow, thanks for the scolding, Krissi.  I'm not sure why you think I'm at putting anyone's life at risk anymore than some of the other types of drivers I mentioned in my post.  I guarantee I am a better driver holding a phone than many of the idiots I pass everyday with both hands planted firmly at "10 and 2."  Thanks for the reprimand but I'm not putting anyone's life at risk anymore than anyone else.  Not sure why it's automatically assumed that anyone talking on the phone is such a shitty driver.  That's not always the case.  It's just the phones are easy to see thus someone using them becomes the easy target.  What about smokers, women putting on lipstick, people changing the radio station or CD's, others scolding back-seat kids, those eating, sleepy, etc. as I already mentioned?  If you honestly believe that everyone on the road is always facing straight ahead, focused, with both hands on the wheel you are deluded.  You can't even possibly be doing that at ALL times.  QUIT PUTTING MY LIFE AT STAKE, WILL YA?  FOR GOD'S SAKE, DRIVE SAFER!!!!!!!!!!!!!!   luci

I'm betting it doesn't prohibit talking on a cell phone, it just prohibits holding one. That's NY's law at any rate. You buy yourself a hands free adaptor if you want to talk or you pull over when you get a decent signal.

i read the results of a study into causes of accidents--or crashes, as they are now referred to--& the number one cause of accidents was the  driver being distracted by passengers in the car...so if that is true, why are there so many seats in our cars??  why not make it illegal to have passengers?

exactly.  That's not the popular answer though.  It's easy to pick on phone-users, especially if you don't want or need to use one while driving.  Thanks for the info.  Very informative..................luci

Yeah, people forget about 'hands-free'...   One doesn't need to fork over the dough for Bluetooth (though I did and find it the least hassle)...you CAN attach about any standard head-set to any cell-phone; so 'hands-free' outta be a piece of cake!
 
I wonder how many people even KNOW they can 'voice train' their phones; I can just say 'Phone Home'...and it does.  No more dialing for me.  Your phone probably does this, too.  No biggie...

 
The odd thing is, it's NOT just holding ore even dialing a phone that is the worst; people actually TEXT MESSAGE on their phones... while driving!  Sheeshhhhhhhhhhhhhhhhhhhhhhhhhhhh
 
Personally, I think these laws are passed to protect US from such people.  Kinda like helmets on bikers; I'd rather they/I loose a little personal freedom in exchange for not having to see brains smeared across a windshield.  Same with seatbelts; I don't want no stinkin' bodies comin' through my windshield...should somebody crash into me.  I want them to stay in their own car!!!

PS...there is something else to be said for 'hands-free'.  The microwaves that heat-up a phone when ya talk a long time...apparently also warm up the brain to a depth of one inch.  Something about that gives me the hebiejeebies!  Use a headset of some sort and save yer brain!
