Lady E, while  I understand your point of view, I reiterate that it appears that her problems were not as a result of her gender, but of her failure to understand the entry process,  along with a negative attitude that was "just begging" to be slapped down - and likely was.

She attributes all her problems to forces outside herself.  She projects, rationalizes and excuses, and accepts no responsibility for her own actions, intentions and words.

Well said, Firm.   That's not a round-about way to the other side of the story, that's the official version, and it matches nicely with the bits she kept changing.  Case closed.

LadyE, I would be very interested to hear what response you get to your inquiry to our Immigration dept.  I'm afraid the credibilty of this potential 'poster child' is completely shot.

So I go over to the website to have a look, and I find a copy of the official report with her comments added.  I might even revise my earlier comments.  If she can write a train wreck this amusing as a produceable script, instead of just a 'life as art' bit of self-destructive dramedy, there might be a need for her skills in my country.

as far as I'm concerned I proved BEYOND  REASONABLE DOUBT that I fulfilled the entry requirements of the Visa Waiver Program.

I'll admit, she does have some skill in writing, but the question is does she have talent? A talented writer sees to the heart of things as they truly are, not as they appear, or as they wish for them to appear.

FYI, I had to laugh at the "Beyond Reasonable Doubt" comment she made. That's standard of proof in a criminal trial, and is a pretty far fetched standard for admission into the US (or any country).

The real standard for admission to the US - or any country, for any reason - is "Convince me.". There are no rights attached to admission, which the "Reasonable Doubt" assumes.

A little fun ...

Perfectly Legitimate Example of Denial to Enter the US:

"I want to visit your county."

   "No."

"No?! Why not?"

   "Because I said so."

"Not good enough, you Nazi, Bushilterite, Jew-Dog Republican neo-con instrument of Capitalist Oppression!"

Border Official tazes, handcuffs, and detains until next available flight.

   *Yawns*    "Next!"

Given the excerpt from Stella's site in relation to the reasons for refusing entry, (I'm out and about a bit much at the moment to keep up or spend much time here!), it would appear to me that absent any issue over her gender status there yet remains an overabundance of grounds for refusing entry, and whilst her gender status may have played a part in attracting attention to her, there does not seem to be any evidence aside from Stella's own testimony, that her gender status played any role in forming grounds for refusal of entry.

Still, the principle is worth examining, and I shall post when I hear back from US customs and immigration on the question I posted to their website - albeit that they have in the meanwhile confirmed receipt of my enquiry and advised that I might not receive a reply for two months.

I agree the principal is worth examination.  I also believe that gender orientation shouldn't be part of the standard of immigration.

This is an issue where many other legitimate factors were clearly the reason for her denial.

M Ellen, perhaps a new thread on the topic itself is worth a go?

Regards,

Stephan

Hi Stephann

Yes - I expect that by the time I get my reply this thread will be long gone, so I guess at that point I could start a new thread on the subject.

Although, I would guess that 99% of posters here would agree with you and I, if I read you correctly, in that gender presentation should not be any reason for refusal. Indeed, I'm expecting a reply which will confirm as much.
