Maybe you can flip the script on him and say, "How much am I going to get paid next time?  I'm trying to figure out how much effort on my part that equates to."  [;)]

I think that is where you might be able to object legally... it sounds very arbitrary to me. Has he provided you with a specific list of the infractions and how much they will cost?
Also, he may find that providing you with the documentation to back it up may be a bit more of a hassle than he thought.

As a pragmatic businessperson and not as a close friend, you are much too intelligent and valuable to put up with this.

As a close friend - I appreciate you are dealing with a lot of circumstances beyond your control and dealing with factors beyond simple employer/employee. I sure you know he's using your situation against you. I sense your desperation. Let me know if I can help in any way.

From the reality side of the equation...

The problem with taking legal action is that it would be expensive and ultimately may not help short term. You'll likely be out of work and have zero income instead of reduced income; and again that may not be the only consequence. I happen to have to talk to an attorney today and I'll see if she has any suggestions. In the meantime my one suggestion is to have him put his policy in writing. If he's sent you an email documenting what he's planning to do, that will serve the same purpose.

California is an 'at will' employment state. Unless there is a contract involved, personal or union, anyone can be terminated at any time for any reason, or no reason at all. However I think there are statutes regarding compensation. I think compensation must be established before the work is done. I have the statues at the office. Feel free to call me there later if you want.

I trust you have your resume updated.

From what it sounds like YOU have the upperhand, if its true he can't afford to lose you. Be careful and really determine what your worth is to him. You said without you the business will go under, is this REALLY TRUE or is it your ego talking. Now don't get your knickers in a twist because i asked that, but really decide which it is. because if its your ego talking, then you really don't have any leverage. Also, how many mistakes are made that he feels this is an incentive? Perhaps there are more being made that are actually harming the business than not. Its odd he feels he has enough with regards to mistakes to benefit so to speak by using mistakes against his employees.

NOW, if its true and you are invaluable, the YOU have leverage. I would take this weekend and write up in detail and with evidence to show why you know you are invaluable and he can't afford to lose you. Then you have to make a very important decision, how much are you willing to put on the line to bluff? If you are as invaluable as you believe you are, then you can use that to simply tell him you are not willing to work under those circumstances. He will do one of two things, say too bad you don't like it leave -- in which you should be prepared too, or he will want to discuss it. But you have to decide if you are willing to work under those conditions. If he thinks you will, he will maintain the status quo. However, if he sees all of his employees are willing to walk out due to such working conditions and be willing to quit instead of working under such assine working conditions, he may wake up and realize that is not a way to run a company.

It could be he is trying to get rid of some people and don't want to fire them because he doesn't want to deal with unemployment for them.

So is this a weekly thing and your pay goes back up to the regular pay (you start over every week?). This is just really odd concept.

All in all, it sounds based on your saying he knows he can't lose you or the company will go under that you have leverage. Decide if you are willing to bluff based on your surety of that and put him on the spot. Hell you may be able to get a raise out of it lol.

Good luck, either way, sounds like its time to find a new job with a company that values its employees rather than raise the stress levels of hard working employees.

I do all my CM and other "browsing" using the "InPrivate" option. I'm not sure that it does much good except keeps certain people from being able to pull up my history. I'm sure somewhere in the bowels of the mother board it is clear what sites I visit... but...
