James told every one he wasn't living in the trailer any more, however he was still paying rent, so he's still legally a tenant there. and management drilled the lock on his trailer, supposedly to check to see if he was dead inside or not, because nobody'd seen him in forever. WEll now the owner is playing these petty little phone run around games and will not set up a date to be there to give him a key to get into his trailer and every time she's said I'll be here call me management says she's not here or she can't talk or can you call her at say 2 oclock, and then she's nowhere to be found.  It's quite easy to bust into your own trailer, he won't though because he's afraid he'll be arrested an booked for BnE. So where we stand right now we can't get any of his property, and the months almost over and after this month he won't be a tenant any more cause he's payed last months rent. He's also afraid they've gotten rid of his stuff trailer and all when he wasn't looking because management and owners are kind of shady. the whole place is kind of shady. they're forever having new management like every month cause the old management quit.

He's still legally a renter there, and her bullshit is unprofessional. He was going to call a probono lawer for advice, and maybe even go so far as a litigator, my suggestion would be to call the sonoma county police department tell them what's going on have a police officer go to the trailer and demand management let him in, or watch out for him while he breaks into his own trailer.

Would the sherrif typically be willing to do that? He can proof it's his trailer, they just wno't give him a new key after drilling the lock an replacing his old lock.

If one can prove that it is their trailer and the space rent is paid then enter it by what ever means necessary and be done with it.  If anything is missing call the authorities and file a police report.

The sheriff won't want to get involved. (unless he's an unusually nice and understanding guy)
He won't get a b&e that sticks if it is his legally rented trailer.
He may, however, have to pay for damages, if something gets broken doing this.
The landlord hasn't a leg to stand on, and knows it. She/he is just waiting for time to run out of his lease.
This is all a matter for civil court.
If I were him, I would contact the owner, and tell him everything that is going on, and that if he does not have access to his trailer and his things by tomorrow at
10:00 a.m., then expect to see him in court. Tell him you have written records of dates and times the manager told you he/she would meet you but didn't, and that as far as you're concerned, you not only owe him his stuff, but a month's rent, since you were by all rights, evicted. This is an illegal eviction, and you can collect punitive and actual damages should you go to court and the judge sides with you.

If he can prove ownership then the cops can let him into the trailer. Technically the management are the ones who have violated the laws by changing the lock on his place of residence without permission. IF he calls them while they are there, and they tell him they cant find whomever he is supposed to talk to, that will serve as a reasonable effort to contact them and get the key and they should be able to drill the lock. OR, call a locksmith and have them drill the lock for you, as long as its his trailer, he can have that done same as if you had gotten locked out and needed to get back in. I had to have that done on an apartment I was housesitting in NY when the lock on the door automatically engaged when i threw out the garbage and the key I had didnt work for some reason. They didnt ask questions, the locksmith just asked for ID proving I was supposed to be there. My license was in the apartment, so that was all we needed.

the sherrif gave me a number for him to call, it's fair housing, and it's the department for land lord / tenant disputes. They said if he shows up to collect his things and management causes a stink to call the sherrifs office an they'll dispatch someone.

Their excuse for drilling the lock was to check to see if he or  was dead inside the trailer Probably because his trailer stinks. and because nobody had seen him around for weeks.

which may or may not hold water cause his trailer does stink, because he keeps it messy all the time, and he could of told people he was relocating just to throw them off his trail and killed himself inside counting on the fact nobody'd check on him for quite a while, or he could have been murdered.. I am  on the fence about this excuse, as valid/ not valid.

Either way the rest of the behavior is not excusable.

  There is a tenant resource center near you.Most every County has one.

They are there to help and answer questions like these.

Google a bit or ask around.

In most states you can get the police to force management to open the door for you and to go with you when they do so if you have not been evicted .. .. so take rent payment receipt or canceled check to local police and talk to them .. if that doesnt work .. call main office of management company .. not the propery office .. and if that doesnt work .. send registered letter telling them you are cc BBB and state Apartment association ...

I am a former Apartment Manager .. and this holds true for almost every state .. so is a place to start.

I had to go to small claims court against a former landlord. I went in a bit early, to get a feel for the judge, what he liked, what pissed him off, etc.  He came down VERY hard on any landlord that stepped even an inch outside of the law. And denying him access to a legally-rented property, and his belongings, is outside the law.

In my case, the judge asked us to go into mediation, and when my landlord claimed ignorance of the law as an excuse for what she did, the mediator told her that if she was going to own rental property, it was her job to know the law, and basically that she didn't have a leg to stand on.

Small claims court is cheap to file a claim.

to the OP,  you might be being told 1/2 the story.    you need to read every word of the written lease.  a tenant does not have the right to jeopordise others safety/sanitary/peaceful enjoyment.

why does the place stink?  one has to deal with that.

Pahunk... true about not jeapardizing... but the solution is NEVER lock out, not in this state.

I've never been in a state where it is legal to lock your tenants out without a court ordered eviction.

He needs to keep it clean though. Hope they didn't take pics when they went in.

It stinks in there cause it's always messy. it only stinks when you go in, not like stinks so bad you can smell it miles an miles off or nothing, and certaintly nothing like a dead rotting corpse would lol.

Blushes I agree, he needs to keep it clean but I wasn't living with him and he figured it didn't matter if his place was always filthy cause it was just him an he's never home.

we have tough laws here too,but that doesnt stop landlords from padlocking and cutting utilities.  i had that happen just last year.  of course the more he did that- the more mad i got.

in any event- re-read the lease. it should be spelled out.
