The law does provide a distinction between 'lawful restraint' and 'unlawful restraint', at least , here in NY, and to my knowlege, most of the States( you 'strines are on you own for this...). The main differance is that the restraint is applied by a dualy authorised agent of the state ( a police or peace officer) and the the restraintee has been advised of the reason they are being taken into custody, and of their rights as a prisoner.
