Beginning Saturday, DC Police Chief Cathy Lanier has decided to set up random roadblocks in one DC neighborhood to check citizen identification reminiscent of SS tactics in Nazi Germany or Occupied Paris.
These checkpoints are a clear violation of the Constitution and should be REPORTED and COMPLAINED ABOUT to the DC Office of Complaints.

WASHINGTON — Stung by an outbreak of violence, including eight killings last weekend alone, police are taking the unusual step of establishing vehicle checkpoints in a crime-ridden neighborhood in the nation’s capital.

Starting Saturday night, officers will check drivers’ ID and turn away any who don’t have a “legitimate purpose” in the area - a plan that has drawn swift criticism from civil liberties groups.

“The Constitution and the Bill of Rights should not become the next victim of the street violence,” said Johnny Barnes, executive director of the American Civil Liberties Union for the National Capital Area. “This plan will treat every resident of that area the way criminals are treated.”

They've got to be kidding. Freedom of association, and therefore movement, is one of the most basic rights guaranteed by the Constitution. I hope the ACLU sues their pants off.

Hey, if you've done nothing wrong, you've got nothing to worry about, right? Right?

I don't condone this action, but I wonder if the reasons to do this is borne out of the frustration of trying to figure out what to do! (lol sorry that was long winded.)

It is to be expected when the Executive is spending most of their political capitol trampling the Constitution that local authorities would eventually do the same

wow... you sure got a headline there...

its hardly martial law ... you might want to read a bit more about this before deciding what it means...
and they did it last weekend, so this will be weekend two... your news is a week old

yep.. it may have legal implications, and she may not have done it right..
but its weekend two and the ACLU hasn't filed anything yet...

by the way, do you live in DC?  Don't think so.. you live somewhere else...

I feel strongly this is wrong. However, about the only time i ever disagree with the ACLU is on issues like this. Where, while i agree with them, part of me says, if i don't have to live in that neighborhood, then i should consider what the people who do have to live there feel about it.
I feel the ACLU should find plantifs who live there to act as the plantiffs in a suit against this clearly unconstitutional act.

It's got to be said that 'marital' instead of 'martial' is an unfortunate typo  .

I'm just wondering how will checking ID's stop random killings?

Checkpoints such as these have been challenged in court before. They are legal and used in many other areas of the Country, usually as a means to get grunk drivers off of our highways..

I have no clue... and I don't necessarily condone the tactics, you'll have to check with DC Metro.. but I did, many moons ago live very near that neighborhood.. and its a war zone...

While you are quite right about that.. they are often challenged.  They are less likely to be challenged however if they are for a specific purpose such as drunk driving -- critics of the current checkpoints say these are too broad

I can understand checkpoints for drunk driving... say on new years... but not just to check who is in an area...just in case a killing occurs.

I don't necessarily want anyone to know where I am going... let alone the police...none of their business.

Martial law is the system of rules that takes effect when the military takes control of the normal administration of justice.

Therefore, a police chief ordering road blocks and check points in a neighborhood that has recently had an escalation of violence does not fall under the definition.

Furthermore, unless the action taken is prohibited by city charter and ordinances, it is well within the legal authority of the chief of police to take such action.  It falls under the heading of protecting public safety.

Only if the action can clearly be shown as racially motivated is it unconstitutional.  This does not mean that if the neighborhood is predominantly non-white, it is racially motivated.

While the random checks of identification is not illegal, any search of vehicles based on those stops alone would be, there must be probable cause.

What you are discribing is similiar to actions taken in NYC, LA, and other large cities after outbreaks of gang related violence.  Increase patrols, establish check points for random stops, and pray that your officers dont become targets.

The American public is under the misguided notion that any activity that increases a police presence in a particular section of a city constitutes police oppression.  Good examples of police and law enforcement oppression can be found just by looking over the video records of the Berkley Protests, Kent State, and any of the civil rights marches in the south.

There is no easy way to deal with gang and drug related violence.  An officer involved in a shooting with gang bangers will more than likely find himself under invistigation from Internal Affairs and sued by the kids parents.

And please note, these gang members just spray bullets from a moving car, meaning that everyone is a target.

You still want to complain?

Its a lot more than "a killing"  ... its a consistent pattern of murders....

So now they can have gay marriage in D.C.?
What's the "problem" with that?
Now the senator from Idaho with the "wide stance" can marry his boyfriend.

I know this sounds revolutionary but...instead of setting up checkpoints...why not get those police officers out of their cars and on a walking beat in the neighborhood?  Who knows if people can talk to them...or get to know them...maybe crime would decrease.

Actually they do.. you might want to read up on Cathy Lanier -- our police chief and many of the things she's done to improve
policing in DC ... including police officers walking a beat.. all over... she's made great strides...

this is, by the way, one neighborhood check point.. not plural all over the city

It used to work quite well. A beat cop walking got to know people in the nieghborhood-and actually made friends. Which means he also had back up and info. But I guess that is just too friendly and effortful for modern day law enforcement.
