greetings cyberdude,

there are two schools of thought on this - that culturally appropriate laws can be used for those of different religions (for example, britain already has separate systems for jews who choose to use them, to my knowledge) in certain cases (within islam, this makes sense especially regarding marriage and finance as western courts generally do not have a family law system as there is in islam and islamic financial law is very different). and then of course there are those who believe the same laws should be applied equally in all cases, all across the board, regardless of whether they are culturally appropriate. in my experience, this leaves muslims - especially muslim women in the case of marriage - reliant on their own social communities to try to enforce the rights accorded to them under islamic law, which in many cases turns out badly.

ultimately i think these statements are the most important:

This isn't new - came out months ago.

This suggestion is made in regards to legal conflicts opposing people who are Muslims. England already has provisions made to apply certain aspects Jewish law too, in matters of marriage and divorce. This is the kind of legal context Sharia laws would be applied.

And quoting the Daily Mail, really... couldn't you find a slightly more serious source  ?

I hope to christ this PC bullshit doesnt ever fly in America. If the UK wants to throw their country away thats their business.... But as far as I am concerned in the USA there is no such thing as "Islamic Law". There should be US Law, which covers anyone in the US regardless of what faith they choose to practice and then if someone wants "Islamic Law" they can hop on the first thing flying to an islamic country. I mean really where will this kind of bullshit end - oh no officer see I wanna be tried in Unrestrained Baptist Court cause we dont believe in seatbelts.  Oh No officer Im FLDS so Im not a pervert, charge me under FLDS law and try me in horny mormon court. Posioning poeple, absolutely not that was our sacred Koolaid and its legal under Jonestown Law.... Obey the laws of the country you are in or get out and go to one of your liking.  This is a slippery slope to hell...

I take a very simple line on things like this. This is England, where English law is king.

By all means practice different cultures, for variety is indeed the spice of life, but the bottom line is that the law is there to be respected, and its ruling is final.

If you're prepared to adhere to the laws of this country, then all well and good, but if you find them not to your liking, and would prefer to live somewhere that offers a different legal system, then please feel free to emigrate to whichever country best suits your needs.

Simple, no?

I wish he was as upset when the neo-cons established Sharia law in Iraq....

And not the quasi Sharia-like practices,as in Europe but the real kind, with  roving armed "morality patrols", looking to punish any and all infractions of Sharia law.

When will neo-cons own up to not only accepting Sharia law in Iraq but helping to re-establish it there?

Seems to me that that`s a real problem, with real victims and real consequences.

As others have pointed out, this is old news. There are Jewish civil courts that operate within English Civil Law so why there should be a problem of muslim civil courts operating within English civil law is beyond me. These courts are voluntary and English law is supreme so it is no big deal. If anyone within these minorities have a real problem they can resort to English civil law which has jurisdiction. Note, that this is civil law not criminal law, there is no debate about compromising British criminal law.

This story has been monumentally misunderstood. What Lord Phillips said was not that Sharia law should be put on the statute books or incorporated into British law. What he said was that elements of Sharia law could form the basis for conflict-resolution agreements between Muslims i.e. its use would be voluntary for both parties. It's really a non-story because they can do that as it is. Hell, two people can use the Bible of Elvis in dispute resolution if they wish.

When producing legal contracts the agreement would be able to be framed within context of Sharia if both parties agreed and so could ensure that there was no conflict with Civil law precedence. Whole issue is out of proportion, but it has clarified some earlier coments which cold have been taken to imply the use of Sharia in criminal cases which of course would be rubbish.
The only issue I can see that could be a problem is where one party is seen to be (or potetnially could have been0 coerced into a Sharia contrct / law agreement which provides less protection than an standard civil law case would have provided. Particularly related to divorce settlements etc. When this arrises I'm sure the use of islamophobia will be raised again.
