It's not necessarily grand theft auto. I don't know how it is in other states, but there is a misdemeanor charge here for driving a car without permission.

However, insurance fraud is usually a felony in most places. So I'd say to the OP to not go along with that type of deception.

Well so far I have only been extremely truthful and up front with both the authorities and the insurance companies as I do not want to drop myself or anyone else for that matter in the shit.

And yes I have already told my friend that I will compensate her for any financial loss that she incur's through this unfortunate incident.

FL has dangerous drivers on the road.

there are gramps driving the old Buick at 5 MPH- with Datona spring break kids ramming 100MPH in the next lane.

anyhow- best to make the best of a bad situation.

I recieved this from another friend on CM, as I had asked for their advice.

Auto Insurance is on the 'household', it is claims against the policy that will add up, not a specific driver or vehicle.

Claims that the car was taken are only going to help her if there is a police report on file before the accident...your friend isn't the first person to think of this sort of thing.

All auto insurance in the US is controlled by the regulatory office for each state, as is the criminal code regarding auto theft, so any advice that Hillsborough County has their own laws is pretty much uninformed.
And parents also get sued and sometimes even prosecuted for insurance fraud. So do 'friends'.

Most states laws are at least similar, I would not go with the no permission story. In Ohio that is a first degree misdemeanor and could get you six months in jail and a thousand dollar fine.

Conversely, if there is any reason that you should not be driving, your friend could be charged with what is called wrongful entrustment. I just went through that shit last year, and paid all the fines and costs for somebody else because they were pretty much shielding me.

I can't say much more because even though state laws are very similar, they are not exactly the same, and I don't know all that much about Florida law. But I know this much, lying is something you do when you actually did something wrong.

Did you have an IDP ? Florida is used to those, but I am not sure how they look at foreign driver's licenses. They don't have much choice but to recognize an IDP, but anything else is up to them.

But here's the thing, how much damage are you talking about ? Is there going to be a million dollar lawsuit or is this just a fender bender. Nobody was killed ?

Whether you did something wrong or not, stick with the truth unless you are VERY VERY good. I have said that I will not lie to people, but the government, it's open season on them. Thing is I know what I am doing and I know what they can verify and what they can't. So don't lie unless you really really have to.
