This is over a legal substance.
WTF. Why don't they just outlaw tobacco? (Yes that is rhetorical)


Granted being a non-smoker living in an apartment over a smoker can be nasty, but to outlaw smoking in your own condo just because it shares a wall?

Small pharmacies can't rely only on prescription sales, they need other revenue such as sundries and.. cigarettes. They often sell PlayBoy too...

IMO they are doing this ass-backwards.

This has always been one of those things that makes me shake my head.  The original argument was that we are raising taxes on smokes to cover the cost of the health issues they cause, and then they make it so that those that wish to smoke (who are paying basicly a luxury tax to do so) knowing the health issues cannot buy them, let alone smoke them.  Where is the tax revenue going to come from to replace the cigarette taxes, once nobody in the city can smoke?

I don't even want to talk about how closely these kind of laws resemble the sodomy laws... maybe the next proposal will require tobacco sensing devices to be installed in all new construction.

In my experience of apartment living and house renting, there's always been a no-smoking inside rule. I always saw it from the owner's point of view and kindly went outside... never bothered me a bit. Now, if I owned the place, like a condo, I think I'd still go outside but out of my own free will, not because someone dreamed up a law that assumed my neighbors would be bothered. This is ridiculous. San Francisco, how could they be so dumb?

as long as we are at it- people throw out all types of things on the road. soda cans, beer bottles, cigarettes, candy wrappers.  I clean up these items every week in front of my house.  I have a huge tobacco plant that grew from being thrown out the window.

In this neck of the woods- smokers rule.  That and splash on cologne and lets not take a bath for a week.  The non-smoker is the minortiy.

My best friend Jim, confuses - well if I am a true friend- I will deal with his smoke.  Well it is in the carpet- on the walls- in the couch, so I suggested sitting outside "while we have nice weather". Even then with the door open the smoke smell from the house was too much.  So I cut the visit short.  Speaking of smoke- he has burned his clothes, his carpet EVEN his eye glasses- WHy?  he is too hopped up on pain pills, and refuses to moderate.

I try not to be a jerk- but I simply can not breath around it.

As far as banning smoking in ones home- I think this will test the supreme court.

We are experiencing the same types of "laws" in my small town, all aimed at the absentee landlord.  Tho they would love to push it to the homeowner.   Once one town gets such law- others follow quickly.

But like many things in life- it isnt who you know... but who you blow.

I'm a smoker, and I wish they'd either stop with all the stupid incremental laws and ban it, or go to a reasonable approach like I don't know, the owner of the property makes the call on smoking. Like if I own apartments I can make them Smoking or Non-Smoking because I OWN them, and renters can make a DECISION to live there or not.

I'm sure I would quite if it was banned, but if I can buy them I'm going to smoke them in any place that I own, if I select to until the government pays my property taxes, and pays for upkeep on the property I will smoke as I wish regardless of the little Nazi laws.

If they fine me, well, they'll have created an enemy for life. In a small town, of less than 20K people one person can make the governments life hell legally.

It'd be grand fun.

As long as they don't outlaw "pot" I really don't care.

I know in Chicago it is illegal to smoke in your car when there is a minor in the car.  Chicago was also voted the most restrictive city in this country.

You can't smoke outside in the parks, at the ballparks, indoors and just about everyplace else.  Because they say smoking is bad for your health.

Well I don't smoke and I want those dam huge buses that spew black smoke in your face as they drive by made illegal, how can smoking be worse than that?

There is one common denominator of SF, Chicago, and LA where they banned fast food places; the political party in charge. However since they are all with "good intent" or "for the children" who can argue. What is a little freedom and liberty lost in light of those arguments?

I'm a smoker.  I own my home.  I make the rules in my home - period.  If someone comes over who is not a smoker, they can either deal with the fact that it is MY Home and I'll chose to smoke or not smoke as *I see fit - or not stop by.  Doesn't bother me either way.  If they show up on my doorstep though, and then bitch or whine about me smoking in my own home - they'll be told - yes TOLD, not asked - to leave.  If they're alergic and ask if I will not smoke around them Because they're Specifically Algeric - and I do mean ASK, not tell - I'll consider it.  But it's still My home - and if they want to be in My home, they'll do damned well to keep their mouths shut about My vices.
 
That being said, I'll ad this.  Laws of such nature remind me of why I avoid going to California - the Granola State (land of Fruits, Flakes, and NUTS) - and prefer to do my vacationing primarily right here in my own state.

Those who would give up liberty for the sake of safety, deserve neither liberty Nor safety.  Cliched?  Some would say it is - personally I consider it a Truism rather than a Cliche`. 
 
My 10 yr old's father and I had a HUGE fight about this, while custody issues were being settled.  He attempted to convince the judge that he should be allowed to dictate things like whether I was allowed to smoke, when, and where - and whether I was allowed to date, what circumstances I could do so under, whether or not I was allowed to have non-female company in my own home, etc.  The judge, surprisingly enough, agreed with me that his concern wasn't over potential second hand smoke problems - it was whether or not he would continue to have some nominal control over my life, even though he was no longer part of that life.
 
I'm 42 and well educated.  Not 4.2, and needing to be somehow "protected" from the rest of the big, bad world out there.  I'm more than capable of making my own decisions, and facing the consequences of those decisions - for good OR bad - without some holier than thou do-gooder telling me that I need to be protected from myself.

This is a tough one that I see two sides of.

It sort of seems wrong to tell people what they can or cannot do in their own homes, because where do we draw the line then?  You can't fry a steak because there's an offended vegetarian in the building who gags from the smell of it?  I guess it could get pretty ridiculous. 

But we ARE talking about cases (condos, apts, townhouses) where someone's home is underneath, next to, or above someone else's home (unlike a single family home, which isn't attached by any common areas like hallways etc).  I don't know, I have a hard time knowing that the infant upstairs in a crib has to breath in the smoke toxins that are rising up from the lower apartment.  But then I also see the smokers right to be able to light up in the home he pays for.  It's really hard to feel adamently one way or the other on this one.

If I was so addicted to a substance that it ruled my life to the point of social interactions.. I'd get my butt in rehab. (yes, I was a smoker an quit cold  turkey 20 years ago for that very reason).  I've no pity for smokers.  The only shame is that we have to legislate something because an activity is obnoxious.

I don't think that any of us are asking for your or anyone else's pity.  I just want people to leave me the fuck alone.  I enjoy smoking, and I'll quit when and if I feel like it.

house... You mentioned the bus ? Were you aware that the rate of lung cancer is greater for deisel mechanics than smokers ?
