Well hearing day came and we were very worried.  We knew documents hadn’t gotten to the right people and we were walking in with almost nothing.  A lawyer there with someone else felt we wouldn’t get an approval for his disability and tried to help with hints on what to do and telling us things that might help in the future because she was sure the judge would deny him.  I was so scared that the last two years would continue that I almost hired her on the spot, as I saw a woman who knew the law and a likeable person who was helping us for nothing.  Yet, I felt the facts alone should win the case and I needed the money to establish things for his needs and didn’t want to have to give up one penny.  I knew that if we lost I would want to kick my own ass, but if we won, I would be glad I held out for what was right.

At first things went sour.  The judge knew nothing of the case and had no information and what he did have was faulty.  Thank the powers that be, I brought the documents I had!  At first he decided that we should leave and he would later send a letter telling me what he decided.  I had waited two years for this and there was no way I was leaving until I knew the judge saw certain things.  There were two women in the room that worked there and I saw them going through all sorts of facial changes in hearing the story and how I did push.  I am so glad I pushed!  The judge’s way would have cost us a lot more time.

They faxed my ace document that I felt said it all and one he should have had and while the fax was going, he asked about my son’s shrugging his shoulders.  I told him why he does that and it was clear, no adult would do such a thing.  The judge read the document and said… I am approving his case for the next 24 months as it is clear he has serious damage, but 24 months for a review in case we have a miracle.  I said we can always hope for that and smiled and then bowed my head trying to absorb what had happened. Something rare in a hearing.  An approval right on the spot. I had to really control the need to cry as I said thank you to him

My other son said that the one woman was sitting behind me after seeing the document and crying.  I can’t explain how all this has affected me.. as I swing from happy to relief and now a release on two years of having to be a warrior and a survivor.

I don’t know how much money he will get or when… but we are close to life changing and finally being able to get on with whatever he can now learn.  Oh… and by the way… he kept me up all night before the hearing playing with the bathroom door and watching me… it was the first play in over a year and a half.  He did well at the hearing and we saw him excited and even helpful as the lawyer’s case started to fall and he reached for it!  That doesn’t happen!  So he is making progress and things are looking up!  Thank you to everyone who was supportive and helpful in our process!

Congratulations, Lockit!  There was really no other acceptable way but approval.  Everytime you go to the doctor with him keep records and occassional ask for a written evaluation.  Even with a brain injury or the like, it will be reviewed every 3-10 years.  Again, I am glad it went your way without further delay.

ooh Lockit, Im so happy for you and your son, that is amazing news, congratulations, all that hard work has paid off, its horrible you had to go thru all that, but you did it !!!:) I wish you only the best for your future, huge huggs to both you and your son.

Oh Lockit that brought tears to my eyes. I know well the struggle to prove disability and I am glad glad glad to hear of how things worked out for you. Honestly I can't even imagine how that relief feels but I hope it carries you through any future bad moments, knowing that sometimes things actually do work out.

Thank you everyone... you have touched me over and over throughout my just over a year at CM and once again... you hit me in that tear zone. lol  Dang it, I am supposed to make people cry!  Anyway... it is a wild experience and one I am wondering how to discribe as I write 'Loving Charlie'.  The relief releases me to be able to put down my guard and just breath again and that is both a happy and positive thing and then also one where I find myself feeling things that are more like saddness. lol I just can't explain it! lol

It will be a time for emotional review I am sure! lol

I met a man living in a shelter, who had been seeking his approval for five years.  His lawyer was reading his medical evaluation freely in front of all of us, as we had spent an hour talking personally with one another.  As she read, all I could think was, ouch... my god... how does he do it?  We then shared some pain helping tips for our backs and I asked about his living situation and then we talked about that, as I could need that shelter! lol 

Having had a support site for people who were ill or disabled at one time, I heard a lot of stories.  It really is a shame that some scam the system and the system scams us sometimes.  It doesn't work well... and even though papers were not sent many times and such... it was as if someone was watching over us because what happened, according to the way the system works... shouldn't have worked.

My heart goes out to anyone having to deal with first a disability and what it means to not be able to work, to having to go years not able to get any help and still survive and make their way through a confusing system that isn't always fair.  They have so many loop holes it isn't even funny!
