I found a judge's punishment worse than many sadists here would dish out.  Noise ordinance violators sentenced to listen to either Barry Manilow or Barney tunes.
 
"U.S. judge sentences noisy offenders to Barry Manilow"

"NEW YORK (Reuters) – A U.S. judge has hailed as a success a new form of punishment for people who go to court for being too noisy -- an hour of listening to Barry Manilow or the theme tune from the children's TV show "Barney and Friends."

Judge Paul Sacco said he decided to try something new after noticing that violators brought before his Colorado court for playing their stereos too loudly, or disturbing neighbors with band rehearsals, kept doing it again.

The usual practice of fining these offenders was not proving to be a deterrent, so he decided to give them a dose of their own medicine and make them listen to his musical selection at high volume for one hour."

Well, I'm wondering if using those recorded works in the way the judge is violates the terms of use or copyright associated with the music... If it were my music, I'd demand royalties be paid. [:)]

Royalties? What about compensation for the breach of these poor people's human rights?

And what of the suits for occupational injury to the law enforcement types who presumably have to detain people whilst theyre being subjected to this cruel and unusual punishment?

i dunno, LadyE.  they didnt seem to give two rat's rumps about *other* people's human rights in inflicting *their* musical tastes on them, non-consentually.  you know?  whats sauce for the goose is sauce for the gander and all that rot.

i vote for a simple sound proof booth.  you know, like the type at the audiologist's, where they test your hearing.  that would protect the innocent law enforcement type.

if that's true.....teens should have the most human rights of all.  o the angst! o the inhumanity of it all! 

i'm still leaning towards the late fallcon's idea of punishment:

public spankings.  on those big screens like for sports stadiums.  with the miscreant wearing a pink tutu and having had a sign of their misdeed hung round their neck.

of course here in houston tx, we have a judge who has sentenced drunk drivers to wearing signboards and walking up and down the street where they were arested.  public humiliation *does* work, apparently, in helping cut down repeat crimes.  he also sentences shoplifting young people to carry similar signs outside the store they stole from.  funny....crime drops in those stores.  i wonder why.  [:D]

This is dreadful PDP! Its perfectly acceptable to treat the law abiding as stupid and deserving of no consideration whatever, but to do the same to those forced into offending by society is simply unreasonable!

Agreed.  How about a fine and some community service. If they offend again, take away their electronics and amplifiers.  Or throw them in the clink for a weekend for disobeying a previous court order.

Listening to Barney songs?   What a joke.

ahhhhh the smell of sarcasm in the morning.  [:D]

seriously, if all that is hurt is a little dignity and forcing someone to put themselves in the shoes of their victim and actually consider what they did?  i'm for it. 

no one forced the lawbreakers to turn up their stereos, in fact they were told they were breaking ordinances and refused to obey the laws.  most people who are fined for noise abuses have already been given a warning *once* and have chosen to disregard it.  you wanna listen to loud music?  ok, fine. 

then again, i have sensory overload problems and literally hear only noise and confusion when there is music (of a reasonable volume, just loud enough to hear the lyrics) and a conversation going on at the same time.  so perhaps i'm not the most reasonable person to issue a decision on such things.  good thing i'm not a judge, hmm?

Actually, I first heard about this being tried by a few others, specifically in So. California, and in Oregon, about 5 or 6 years ago now, and was rather effective.  I love the idea.  The punishment fitting the crime.

I'd have them forced-listening to Richard Simmons singing "Tip Toe through the Tulips."

Never heard that version, but the Tiny Tim version would certainly deter me!! 

I had to call 911 on some neighbors one day for loud music.  The neighbors were across the street & down 2 houses & my windows were closed when I called.  The 911 operator asked me to turn my music down.  When I told her that was the neighbors' music, the officer was there within a few minutes & came to report to me after.  His solution was simple:  If we get called about you again, I will remove your stereo equipment.  Apparently they believed him since I never heard their music again.
