It is only prostitution under the letter of the law depending on how local laws define prostitution. here in the Land Down Under each state has differing laws regarding prostitution with some states having legalised it and others not. However when a prostitute carries on his or her business on Federal or Commonwealth Ground/property she/he is not in breach of any laws for there is no law under the Federal Government against prostitution.. In Queensland however all Professional Dominants of both genders and Professional submissives come under the sex workers act and are required to register and keep to strict regulations health wise and where they can operate.

RedMagic, I agree with marie2 that they probably closed it for other reasons, rather than prostitution. Having sex in public might be against the law there for example, even if no money changed hands, or they could have closed it for lack of a business license, or due to liquor violations, or even due to charges related to BDSM specifically (I doubt it, that usually only happens when there are other charges as well, or if someone is killed or seriously injured). Dungeons also close down due to losing their lease when the landlord finds out and objects, rent goes up, or other reasons that don't involve direct police intervention. Prostitution has a pretty specific, narrow, legal definition, though as IronBear noted, it does vary depending on local, state/regional, and national laws.

Hey, if it works for both of you, go for it! I'd be a little cautious about applying it to anyone you aren't involved with, though. You'd be likely to get slapped or yelled at.

Technically, yes, in many jurisdictions, pro-dommes would have a tough time proving the contact wasn't "sexual" even if no intercourse took place. So it would be classed as prostitution. What the hell. Personally I think it would be better for all if prostitution were legalised. In places where it's legal and regulated, rumour has it that health problems are reduced because prostitutes are encouraged or required to get regular health checks, so both workers and clients run less risks, and the whole pimping/human slavery angle is much less prolific because the pimps have to compete with legal honest working girls (or boys).

Many jurisdictions the prostitution law reads that it's illegal to accept money for "sexual gratification"...it is however up to the jurisdiction to determine exactly what specific behavior that entails.

Reading oceanwinds reply i thought she opened a very important broader outlook concerning that dead horse topic.

From reading here i got the feeling that Prostituion is an obsessive topic in the USA. On the german board i follow the topic also appears, but not that often. My position is that the more legal it is the better is the situation for the sexworkers.

All relationships entail the give and take and i am a firm believer, that as long as all who are involved stay happy or content the balance is right. Because everybody has another value system and is connecting different things with money or gifts no exchange is the same. There are people who dominate with their money and there are people who are able to give money without that power strings attached. And there are people who are dominate by giving sex and there are people who are able to have sex as a however short connection without emotional strings attached.

So to answer the question: Yes we are all prostitutes and we are not prostitutes at the same time. Meaning prostitution in a broader sense. Who of us would not prostitute mind, body and soul to survive. Yes, i know the ones who would steal, kill and fight, but that is the other side of the same medal.

If that is what you concluded from my post you got me totally wrong.

I am firm believer in the right for people to choose freely how they conduct they relationships. I think the law has no right to determine how people decide to exchange money and/or sex more than when it starts to concern civl or criminal law. In Europe we tend to see the topic Prostitution in another way than people in the USA. Northern Europe is nearly unified (think without England, who have although some protestant problems) in seeing prostittution as something we have to rule with the best possible outcome for the sexworkers and their clients on the one side.

And it should be conducted on the other side with as much as possible discretion, so that the neighbours do not get bothered.

In relationships that are not held in a sexworker/client realm, i would not use the word prostitution, i used if you had read correctly exchange. So i did not wrote about your wife, why should i?

I wrote against that moral sword some people here on collarme like to use against people who decide to sell sex/ S/M for money. For me selling is always the same process and i am damned sure, that everybody can freely decide what they sell. Selling day in/day out your smile at a supermarkt check-out is although very demanding.

Rules vary from state to state, but as long as each party is over 18 and it is consensual and does not involve penetration, I don't think the gov. really cares. Now what they at some point may care about is undeclared income in a "service tax". But as long as you're not a 50 year old guy cruising for middle schoolers, I think you're safe. Call it what you will. It is what it is.

OK, I agree with you about it not really mattering, but what exactly is the difference between a sex worker and a prostitute?
