Someone finally gets it! I think a $10,000 fine would be far too kind.

Wow, there's some truly incompetent folks behind the wheel. They can't TALK and drive at the same time????? Talking on a "hands-free" device is no different than talking to someone in the vehicle with you. So these people find it "easier to drive drunk" than to drive while talking with their hands free? Damn, I'm always scared when I get on the road with so many idiots but this really ratchets my fear up a notch or two. Who knew talking while steering was so, so difficult?

People talk, twitter, web surf, ect. Its a distraction.. an added one.. that drivers dont need. I have long felt that speaking on a cell phone while driving should be illegal. often i watch as these drivers drift aimlessly into other lanes, forget turn signals, cut people off, then wave an appology while still talking on the phone. Do they do all that when they arent talking? i dont know. i just know i would love to be alive to find out. Driving is scary these days.

there was a terrible accident around here awhile ago involving a car full of 16 yr old girls. Two died instantly and the other two are facing very long roads to recover. The driver was texting at the time of the accident. How sad. What did she have to say that was so important?

Three members of my family have been hit by some fool driving and trying to use a cell phone.  $10,000 is too low a fine.  The last accident had everyone stopped for a red light; everyone except the idiot on the phone.

Here in ontario we are waiting for the cell phone ban whilst driving to come into law, sometime in the fall it should be there. Fines are low, 2000$ I believe is the maximum, but you get demerit points on  yoru license as well. I have to say cell phone users driving are a huge pet peeve.

we gladly have that law already.....because people also tend to get upset while phoning and don't even hold the steering wheel anymore..lol/

A health care system and a ban on cell phone use while driving!  What are the rules re immigration?  Also, I am assuming that the loyal opposition is truly loyal.

The problem is where do you draw the line. Cant smoke while driving? Cant eat while driving? Cant change radio stations while driving? Cant talk to a passenger while driving? Cant put on make up while driving? All of them are arguably at least as distracting as talking on a cell phone hands free. (And yes, in CA there are women who smoke, talk and put on make up all at the same time while driving)

I agree with the no eating while driving. Again, another hand and eye distraction. Same with make-up. Smoking... yes.. it has caused some accidents when the firey object is dropped into the lap and they have to fish it out. (saw that one alot at the hospital ER)

Problem with hand free is.. can you guarentee its always on hand free? I see so many driving around with their phones in their laps, texting away as they drive. Even with the bluetooth in their ears. There is no conversation you MUST have that cannot wait till you pull over to the side of the road.

There's an interesting bit of psychology: When you're talking with someone in the next seat, you know they can see your face, which means you worry less about getting your words precisely correct. When they're on the phone, you have to devote a lot more attention to the conversation, because you know those visual body-language cues aren't there.

EDIT: Lest I be accused of talking out my ass, I'll try to dredge up the study that I got this from. Back later.

It depends on your definition of "MUST". Im often on a conference call (hands free) that I cannot miss without jeopardizing a client, while en route to a meeting that i cant be late for, for the same reason. With voice dialing technology I dont find it any more distracting than the other practices I named (in fact it is less distracting then many radio programs). so if you are going to restrict cell phones, restrict everything else.

I agree, restrict it all. Makes better sense to me. And i dont agree that those calls are a MUST. a MUST to me would be someone is tailing you with a gun shooting at you. A MUST to me would be a physician en route to a hospital to deal with a dying patient and is giving orders over the phone. A MUST would be a parent dealing with a child in the ER and having to give consent on the phone while driving.

Those are examples of MUSTS. Your client would have to wait. If your schedule is that tightly packed, then maybe you need to rethink your time to give your undevided attention that your clients pay for. Your clients dont pay me, but, your talking could kill me.

Tazzy...there is no law in my state that prevents an idiot parent from abusing their children by smoking in a car. I have seen it happen with the freaking windows closed!!!! If they cannot/will not ban smoking while driving to protect the little ones, i can't see it happening for accident prevention.
And if i does...so much about prioroties.
