I am putting this here in politics’ because this in part, is a result of no medical coverage.

I am coming here to ask that some of you help me with some thoughts on what can be done for a dominant friend of mine. Most the people I have worked with were in a different situation by the time I got to them or they had other resources to help them. I am no longer working on this on a daily basis and my brain just isn’t as clear as I need it to be to really be sure my advice is stable. I do know he is really out there trying to fight back and he is far more with it than most the people I ever worked with.

My friend is in his late fifties, lost his job a year ago when the company he worked for, for a couple decades was sold. He worked in a field that has been changed by technology and there are no longer jobs in this field with his experience. He got real sick and was hospitalized for a couple months, almost died and is now facing huge hospital bills. He was in a coma and his brother started trying to keep things together, but by the time he was able to do so, the social services said that it was past time for an application to cover his medical bills. This I have a hard time understanding as that isn’t how it used to work as they went back three months, but somehow they denied him and his appeal. He was in a coma! How could he apply for anything while in a coma? The social services said that if he sold his house they would take the money to pay back what they have paid in medical after his release from the hospital... I think.

So they will cover his future medical stuff, but not the hospital bills. His unemployment has run out. He has no income. He is now struggling to walk or not fall when walking, his lungs have not recovered and he is at risk if he is in public and gets a virus, but he is determined and trying to save himself and has applied for jobs… but with his age, condition and all, it could be real chancy to count on getting a job in this market.

His lakefront home is almost paid for, it was a family home that he bought when his father died and it means a lot to him. So I think he may be taking risks by trying to save it with all the facts, but most people do that and will wait too long trying to save it all and then lose it all. This is typical in many areas with many that I have worked with and they often wouldn’t listen because of this. I know how to advise him if he has nothing, but with the house I am not sure what he could do. He has checked into the reverse mortgage and he can’t do it because he is too young… I think that is what he said. He can’t get a loan on the house because he isn’t working and can’t get another type of loan because he isn’t working. He could rent the house but then wouldn’t be able to get into housing. He could get a roommate but knows no one who needs a place and won’t advertise at this moment because he isn’t sure what will happen here.

I think he could get some cash off a credit card of a couple thousand, but then there are things that could blow up in his face if he did that. I really don’t know what to tell him. I offered to help as I could in the situation as I knew things… but knowing more, I am at a loss as to what to do.

This is why so many are fighting for the medical reform… but this also brings in social security issues and the economy. You get sick or injured and you are in trouble. I know he isn’t the only one… but still I am asking for your help to advise us in area’s that are unfamiliar to us, as I know many of you know far more about some things than we do.

It is rather easy to immigrate to Canada. Do not hope much will improve in US.

What income is coming in to pay off the rest of the house and keep up on property taxes?

Most hosptital bills get put on payment plans. Otherwise, they just damage your credit. The hosptial can not force him to sell his home.

In any case, your friend should seek out legal advice about avalible programs and what can and can't happen within his state.

Actually YES they can force you to.  They can take you to court for your hospital bills, why do you think the leading cause for bankruptcies in this country is medical bills

Because if it were easy (as it is here) the people migrating to Canada in order to gain access to "free" medical care there would bankrupt your system, possibly to the point of collapse. Wouldn't it?  Thats why here, wave after wave illegals (always granted some form of amnesty) will kill us if we implement any kind of a "free' health care system.

He should tap into his 401k or other savings to pay off the house. Putting anything on plastic is the worst thing someone in his position could do. Paying those back at 20 to 30% interest will be impossible. He should also contact Social Security and see what disabillity benefits he is entitled to recieve.

Huh.

Hospital sues and gets judgment.

Judgment then is made lien on real estate.

House is sold. (To wealthy for 10 cents on dollar and middle class is further destroyed.  These are good times for wealthy picking over bones of middle class.)

Whether the house is protected or not varies from state to state IIRC.

I agree that he should apply for disability....and reapply if denied!!  (Alot of times, you have to play the game, but if his doctors think he is qualified for disability, he shouldn't give up.) And also look into bankruptcy.  I am pretty sure bankruptcy won't endanger his home.  If anything, it could help save it.  But I would definately investigate my options on bankruptcy...and apply for disability.

Michigan gives a grandiose homestead exemption of $3,500 for one piece of property.  If the  house is paid off; is free and clear; is located on a lake; and the man is single, such an exemption does not seemingly protect much of anything. I have to admit that there may be "progressive" states that attempt to restrain such theft by meaningful exemptions. Bankruptcy exemptions would have to be examined by his attorney.  I refused to read the bankruptcy act after bush re wrote the act with the  "bankers, credit card and lenders" relief act.

You are absolutely right about asylum seekers and illegal immigrants Sanity, not to mention health tourists, including from western countries. Doctors here should check details first but many dont due to the oath they take. The system can only stand so much pressure before it overloads.

About Disability. if he is looking for Social Security Disability, tell him to hire a lawyer. Almost all cases, unless it involves renal failure, are denied. Its a fucked up system, and lawyers get a third of the settlement. Better to know going in than to assume they can deny you and it ends there. Its almost like most insurance companies... they rubber stamp denials to see how badly people want/need it.

About the house. He needs to talk to a lawyer about that as well. Maybe an estate lawyer? There was also a way to stay in your home, and get payments on the mortgage. Its like your selling the house, but being allowed to stay there for a time. Im not sure of all the ins and outs of that... like i said.. a lawyer would be his best bet.

Lockit, obviously I have no clue on how to help your friend, but I hope he can find someway to save his home. and his health.
its screwed up in my opinion and experience
All this bickering about healthcare n reform n lobbyists n insurance bastages, should be waaaaay behind getting people care they need without bankrupting themselves. as an isolated case its an unpleasant story and reality, but this is happening to too many americans. It stinks.

I forgot about this thread! I talked to him and he said he had already been to the bank and could not get anything because he wasn't working and had no income. He has applied for anything that can be applied for and now he starts the long wait for a second review on his ssd application. The problem here is that the medical community did a similar thing as they did in my son's case and didn't provide the best in medical reports, wording things as well as they could have been. I did discuss with him some options at this time from what I know of social security and getting new and more information and submitting it, etc.. with a couple of different options.

The basic bottom line is... he is stuck like many others. I believe he should sale the house before there is a lien on it and go from there... but it means so much to him that he is going to muddle through as long as he can after using up most he had already and will most likely wait too long trying to save the family lakehouse.

After over 2 decades with the same company, he has no other assets ? No savings, 401 or severance package ?

Hello Lockit,

He definitely needs professional legal advice as the laws vary from state to state.  Since he is over the age of 50 he is eligible for membership in AARP and could contact them for referral to a lawyer, possibly one who is a volunteer, retired, sliding scale, etc.

This is becoming classic story of american dream. Work hard, save for retirement, get sick on the end so all your retirement money will go to healtcare, live like shit.
