ORIGINAL: Sanity Its funny that he hit a cop right in the face. His hate will get him a felony conviction, with all the trimmings... Maybe not- I heard Mr. Olsen will mount a defense of "looking forward, not backward"; based on the premise that we should not dwell on the past and be divisive, but instead look to the future, and avoid the old mistakes. Peggy Noonan will be called to testify about the "we should just keep on walking" theory. Mr. Olsen's attorney will produce a legal opinion written before the incident, whereby the his legal advisor laid out a legal theory that gives American citizens the right to throw tomatoes at public officials. Based on this legal advice, the Mr. Olsen will assert that he is immune from prosecution, based on the notion that this prosecution would be "ciminalizing policy differences" and that he acted in good faith based on his understanding of these legal opinions. John Yoo, David Addington, Jonah Goldberg and the gang at National Review will be called to defend this theory. Finally, Mr. Olsen's legal council will assert that he is in fact, a former member of the CIA, and as such invoke the State Secrets doctrine, that matters of national security may be disclosed during trial, and therefore the case cannot be held. The fact that the CIA will refuse to either acknowledge nor deny that Mr. Olsen ever worked for them, will be asserted as evidence that his work was of such sensitive nature, that he is in fact a covert agent. All in all, the case is rather murky and complicated, and really, should just be thrown out of court entirely.
