I have asked pahunk, who cant seem to come up with an answer... so i will ask all of you here...

What penalty would you prefer?

Many complain about taxes, jail, ect (and i thought jail was out)...

so, name some penalties you feel would be better...

i personally see only taxes or denial of care on all levels... is this preferable?

This thread isnt about how much it costs... i ask to name a penalty you find more tolerable that taxes, pahunk.. stay on topic or start your own.

So its not ok for, say, an airplane carrier to deny you a ticket because you dont have an id?

I would be interested to know exactly what sort of government you do desire PA...remove the necessary element of penalties from any gov.program/law/regulation how would you ensure compliance?
tazzy,whats with the sigh....was my choice of penalty somehow inappropriate,or perhaps you just thought it was not harsh enough....a flogging or a single tail ?

mike,d arlin, your response was very cute... but not very serious, which is what i was hoping for, a serious discussion on what penalties should be applied vs what has been applied.

An airline carrier is a private company and as such, can decide who will or will not be able to obtain a ticket for whatever reason they deem (read the really really tiny microscopic print in the ticket/contract). Just because the airlines, of late, have been so in need of business that they've been selling tickets to anyone doesn't mean they won't enforce their teeny tiny clauses at will.

I was denied a plane ticket once because my clothing was inappropriate (I was wearing a T-shirt that said "fuck everyone"). Yet, the city I was living in (government run) could not stop me from wearing it, because they had no ordinance that banned the public display of such words (Or, the city's police department agreed with my statement. Whatever.)

An airline carrier is not a government so your comparison doesn't really fit.

What exactly is the offense for which we are supposed to suggest our penalties? I'm assuming it's health care related but it's not expressly stated in this topic's OP.

I am consistantly amazed whenever someone acts surprised at my inability to be serious on a consistant basis....if you noticed I did follow-up with a serious response
But allow me to be clear here...I think the penalties are fine.Do they have some teeth,yes but they are progressive in nature and wholey consistant with the goals of the program.Unlike PA I try to be reasonable in my thought processes...any government requirement that does not have a penalty attatched to noncompliance would not be worth the paper it was written on.

yes, health care related.

as far as the airline carrier... TSA rules makes it illegal to allow you to board without an ID.

Effective June 21, 2008, adult passengers (18 and over) are required to show a U.S. federal or state-issued photo ID that contains the following: name, date of birth, gender, expiration date and a tamper-resistant feature in order to be allowed to go through the checkpoint and onto their flight.

Passengers who do not or cannot present an acceptable ID will have to provide information to the Transportation Security Officer performing Travel Document Checking duties in order to verify their identity. Passengers who are cleared through this process may be subject to additional screening. Passengers whose identity cannot be verified by TSA may not be allowed to enter the screening checkpoint or onto an airplane.

You are right... they cannot deny you a purchase... but without that little idenitification card, you wont be getting on a plane.

So, in relation to the health care debate... what penalty would you prefer instead of taxes?

The very fact that there is a penalty for the individual mandates is punishment enough. I long for the Constitution of my fore-fathers.

In the interest of answering your question though. I think the cash penalties are not severe enough to accomplish the stated goal and only open up a new can of worms. If my reading is correct the penalty for the first year it is imposed is only $95 for an individual. It seems like it just makes more fiscal sense to any individual that does not need immediate medical attention, to pay the fine and save the cash that would be spent on premiums, then when the need arises purchase a policy and use the saved cash to cover the deductible.

Therefore, if this mess is found to be constitutional they are going to need to make the penalties more severe so that the purchasing of a policy and thus entry into the pool is more preferable than paying the fine.

Is that along the lines of what you were asking?

Personally I'm not sure what the ultimate penalties will be... 

(g) ADMINISTRATION AND PROCEDURE.—

     (1) IN GENERAL.—The penalty provided by this section shall be paid upon notice and demand by the  Secretary, and except as provided in paragraph (2), shall be assessed and collected in the same manner as an assessable penalty under subchapter B of chapter 68.

     (2) SPECIAL RULES.—Notwithstanding any other provision of law—

          (A) WAIVER OF CRIMINAL PENALTIES.—In the case of any failure by a taxpayer to timely pay any penalty imposed by this section, such taxpayer shall not be subject to any criminal prosecution or penalty with respect to such failure.

          (B) LIMITATIONS ON LIENS AND LEVIES.— The Secretary shall not—

               (i) file notice of lien with respect to any property of a taxpayer by reason of any failure to pay the penalty imposed by this section, or

               (ii) levy on any such property with respect to such failure.

yes Master Thadius.. and thank you.

Its true, $95 dollars the first year. And then they snatch that from your return the next year. It increases year by year until it caps, i believe, at 750 dollars by 2016-17... somewhere around there.

I asked this question because so many have complained about the unconstitutionality of fines and taxes... so i figured maybe others would come up with a better penalty. The only one i can forsee beyond the tax issue is the denial of health care all together for someone who doesnt buy insurance.

Maybe thats the way we need to go. No insurance, no care.
