A lesbian teen who successfully sued her Mississippi school for the right to bring her girlfriend to prom was left out and was instead directed to a "fake prom" on Friday, according to The Advocate.

Constance McMillen, her date and just a handful of others, including two classmates with learning disabilities, attended the dance in Fulton, Mississippi while most of her other classmates from Itawamba Agricultural High School reportedly partied at a separate prom that McMillen was not invited to.

McMillen made headlines just a few weeks ago when, with the help of the ACLU, she fought the school's decision to cancel prom. The school canceled the dance after McMillen sought to bring her girlfriend and to wear a tuxedo.

As part of a preliminary ruling, a judge decided that McMillen was allowed to bring a girl as a date. The judge did not order the school to reinstate the prom because it was understood that McMillen would be invited to a prom being held by parents of her Itawamba classmates. Instead, that prom was canceled and was replaced with the sparsely attended country club event.

Kristy Bennett, the ACLU's legal director for Mississippi, told NEMS360, that she was disappointed.

"Whatever we find will be brought to the court's attention," Bennett told NEMS. "Whether it is in the damages trial, or whatever. There will still be a trial on the merits. The case didn't end in the preliminary hearing."

McMillen, 18, said that her feelings were hurt, but that there was at least one good thing about the night. The Advocate:

Two students with learning difficulties were among the seven people at the country club event, McMillen recalls. "They had the time of their lives," McMillen says. "That's the one good thing that come out of this, [these kids] didn't have to worry about people making fun of them [at their prom]."

I never went to my prom.

Oh wait- I take that back.  We threw our own prom.  It was pretty cool. Downtown Chicago- GREAT dancing.   A few hundred were there.   this was in the 80s.

The other prom that the majority of students attended was a private party thrown by (I believe) parents of other students.

If I've read the story right, the school sponsored prom was cancelled and replaced with a prom sponsored and paid for by parents of students, a private party.

Basically everything after cancellation of the prom appears to be nothing more than social ostracization by other students and their parents. And while I'm not "okay with that" I also don't think it's a crime to have a private party and not invite someone you don't like.

Its not a crime... it is discrimination. Would the thought be the same if this was a black couple who had been denied access based upon their skin color? Is this really the message we should be sending to, and accepting from, our children? This, to me, was also the same attitude that resulted in the brutal rape in California. The more we accept, the more they will push.

Oh don't get me wrong, I think it's totally fucked up, but the school avoided discrimination (saying she couldn't come) by making it so nobody could come. It's a totally shady tactic, but to me, it's not a matter for the courts.

The courts obviously feel differently, and my disagreement is irrelevant.

The ACLU is investigating. Im imagining the Judge wont be happy. The school best hope they had no hand in the second party, or encouraged it in any way. That little girl may end up with a nice part of the county... named after her.

I'm guessing the school didn't hold the other event, the students did themselves and they have the right to exclude people from a private party. It doesn't look to me like this has anything to do with the school. The school didn't treat anyone as separate but equal, it cancelled the official school prom for -all- students.

Its not a debate of what happened being unethical. I think most would agree the girl got treated like shit. Its a cse of the school's involvement and knowledge. And that will be for the court to decide.

How sad is that? The parents who hosted the private "prom" should be ashamed. What the hell are they teaching their kids?

IF the parents hosted, paid for, and had no involvement from the school district or staff in the hosting, planning or catering of the event, than the school has done nothing wrong.

The parents are teaching their children that its perfectly fine to discriminate against someone as long as you have the money to do so.
