Now that's a rarity. I agree with Justice Alito.

Supreme Court Voids Law Banning Animal Cruelty Videos - CBS News

The justices, voting 8-1, threw out the criminal conviction of Robert Stevens, who was sentenced to three years in prison for videos he made about pit bull fights.

In dissent, Justice Samuel Alito said the harm animals suffer in dogfights is enough to sustain the law.

Alito said the ruling probably will spur new crush videos because it has "the practical effect of legalizing the sale of such videos."

But since when is a ban on filming cruetly perpetrated against animals anti 'free speech' ?

Quick answer: How about when PETA wants to use the footage to guilt us into donating, with heart-wrenching commercials that run during family viewing hours?

Honestly though, if you are willing to chuck one of our most precious human rights because something might bother your sensitivities, I'll join you in thanking God that you aren't an American.

I am not a PETA fan either ... but in the OP, I do not recall it saying that PETA made the videos ... it was some dumb fuck who made video of animals fighting to the death ... how, just HOW the fuck is that not cruetly, and you still did NOT answer my question. Why because you know that banning and being punished for filming cruel and sickening acts of violence is NOT a free speech violation.
I hope like hell you, and anyone else who thinks that shit is about free fucking speech, does not own animals. For the animals sake!
Because ya know what?
If it is a choice of condoning animal cruelty or keeping my mouth shut, I am happy to keep my mouth shut.

Read the news reports again. If they are filming animal cruelty then its illegal, still  - because that is animal cruelty itself. Its the possession of the film that was found to be a protected form of speech.

I'm on the fence over this, some things are really cruel, there are people who get off on that and its sick beyond words. But when we limite what can be described with words or video we lose a part of our ability to share valuable ideas.

No, it doesn't. This case wasn't about them. It was about a law that could just as easily apply to them. A law which the Justices struck down 8 -1.

I agree with this. It's a tough one, but at the end of the day I think I'd fall on the side of making the possession of the film illegal - if only on the grounds that if something is illegal to produce in the first place, there should be no legal right to own it.

He didn't just possess it, he filmed it.

I do not see that they are irrelevant, and more to the point.
I believe THEIR right to live in a safe environment trumps the right of some dickwads, whos mum shoulda swallowed the night he was conceived, right to 'free speech'. And again, if you look at my last post above this, and re-read the actual link it says the videoing of the act.
Not the holding of the offensive material. Although imo anyone who videos\watches\has\condones such bs, isn't worth the air it costs for him to continue breathing.

I am wondering if this ban on depicting animal cruelty that self indulgent - "I'm so holy and pure" - ego strokers want applies only to actual cruelty or or simulated cruelty as well (we'd have to ban a lot of movies).

Also: would the filming of people hunting or fishing land them in jail?

If somebody step on a cats tail and I happens to catch it on video tape - is it off to Attica for me?

What if I see somebody engaging in animal cruelty and videotape it as proof of their illegal actions?  Will I be prosecuted?

If it is wrong to depict animal cruelty what about cruelty towards people?

Can we ban all BDSM videos on the grounds that they depict cruelty?
