Wow, well, where do I start here.

I just found out that a renter we have is a convicted murderer, and beyond that, it was a murder to where they cut up the body and hid the parts in storage lockers. They did this in order to keep collecting the poor guys pension check, for years after he died.

Question: Is there any possible recourse, we might have because this shit is seriously fucked up.... I probably will talk to an attorney, seriously, about if we can do anything, legally.

I mean this is nuts... I have a dude like within 200 foot of me (at least a couple walls in between but still) Monday through Friday, that cut a body into pieces and hid them for years, after beating an old dude with dimensia to death.

We did not initially rent to him, but rather a guy renting from us, essentially wanted out and had a buddy that would take over, so sorta getting this dude shoved on us, as of last week, though we've yet to sign any lease, or collect rent after the buddy left, as the rent his buddy paid is up to the 1st.

Crazy that the other thread about discrimination is on the same page, but fuck, this is beyond tolerance. I really don't feel safe now.

I literally just found out about this like an hour ago, because I was searching his name for another reason, and up pops his head in a fucking mug shot. Click, and story on fucking murder.

I hope he signed a month to month lease!

At least you KNOW about his past.

I always wonder about all the people that commit crimes that have never been caught.
I wonder about those people all around me, that have done things we have no idea about.

Lock your doors and sleep with a knife and a gun until you can get him the hell out of there.
If I had somewhere else to stay, I would go there until his ass is out of there.

Let him stay until the 1st, give him  a few weeks to find another place, tell him to start looking tomorrow.
So you had some "guy" renting from you, and you allowed his "friend" to take over his lease, without checking him out?
Dude, seriously?

No, it's complicated...This is commerical rental, Essentially, the original renter, wanted a partner, but we never formalized a lease that included the "buddy", so all the terms were still with the original, and we at present are month to month. But the original renter, now wanted out, and just essentially left this "buddy" of his here, essentially a floating partner, but the rental was to the individual that left. IF that makes sense.

Rules on no-cause evictions are going to vary widely from state to state. I would speak with a lawyer who specializes first thing tomorrow morning. In some places, that requires a full 90-day notice.

You could also try contacting the parole dept. about the methamphetamine he has lying around the place.

If not, legally you might be able to evict him for lying about his criminal activities in his past.

Did he put the fact that he cut someone up into little pieces on his detailed rental application?
Surely you asked him if he had ever been convicted of a crime, on the application?

At least you KNOW about his past.

This just happened last week or earlier this week I suppose, when the original renter essentially just left. I've talked to them literally about 10 minutes since then as I expected them to kiss and make up.

I'm just wondering if there is any legal claim he might have, over the area. Seeing that the renter was an individual running a business, he then brings in some dude, to work in the business, then the original party leaves the business, and leaves the murdering guy.

I think you missed the black humor in his question.

Doesn't your lease have a provision that sub-letting either isn't allowed or is subject to approval of the owners? Most standard leases do. Your contract is most likely with the original person, however, if you accepted rent, you may be stuck for a bit...but the advice given here is correct, state law varies widely on landlord/tenant issues, contact an attorney first thing tomorrow and if you have extended a lease agreement to the new guy, revoke the offer.

I'm confused.

This guy is a convicted murderer who cut up a body to hide it??

And he's out free?? How is that possible?

I mean a crime like that..isn't that normally some kind of life sentence or at least for many years to the point he would be an old man when released??

It's fucked up he was released after 5 years. I really don't understand the law, you'd think beating an old man to death, then cutting them up, and hiding the parts, in order to collect his pension check would be life, but he fucking got out in 5 years.

If people want proof I'll give a link to an administrator to verify the murder part. I just don't want to post the names up here.

littlewonder, I think you would really be surprised the people that walk among us.
The ones that have been "released", "on parole", the ones that committed heinous crimes as a juvenile and then are "released at 21", and especially the ones that are never caught.
At least, he KNOWS about this guy.

Ask a lawyer if it is true that you can say you need it for someone in your family. I am pretty sure for apartments you can use that as an excuse to evict someone. Maybe you can use the same excuse for commercial property.

I really don't know, I know it was with an individual, because at the time the business he was opening was not incorporated yet, and he was waiting on the paperwork. Since then it has been formalized but the lease has never been admended.

I'll have to ask my partner who handles the paperwork about the rest of the contents.

We haven't signed any lease to this guy, like I said this just took place less than a week ago, and they've fought before but made up, so my thoughts were they would do that again, but it's not looking like it. So, now, I do have to deal with this guy in an official way.

Whats fucked up is that you come to the politics section of a BDSM website to ask for legal advice.

"Hey, according to BigDomCock4U, I have the right to cancel your lease..."

"Yeah? According to Mistress Strapon Deluxe, you have to give me 30 days notice!"

Well, you'll have to forgive me for freaking out, and wanting to find any possible information during the middle of the night. I don't have a lawyer on speed dial, and I figure someone here may be versed enough in rental law, to let me sleep better until I can talk to a lawyer.

I'm looking up shit online to, at the same time. I only belong to one other forum, and I'm not waking people up either over this.

Anyway, this isn't funny to me. I'll ask advice anywhere, until this resolved, it doesn't mean I'll take it as gold, but I'll look into it. Geez.

In Texas, if it is not a landlord/tenant situation, then they can be removed immediately for trespassing.

If it is landlord/tenant, then a 3 day notice has to be given for non-payment of rent, if for any other reason, a 30 day notice, unless there is a lease that specifies differently.

But you aren't in Texas, so....
