Hibbie, not only will you snort, but you will start speaking in several other languages at random times.  On the flip side, I will also start picking up Italian.  I will also be able to sew like a designer, and will ratchet up my level of mean-ness to the point of having to change my sig line to "I'm not sorry," as well.

I know that all the legal ized people have chimed in and the lovely money people. How about a people person / educational person?

I have never thought "college" was the most important thing. Education, sure, but college itself? Meh. Ask Bill Gates some time. What about having the kids use the money for non-college education? Take a tax class, some apprenticeship classes, even martial arts. The *spirit* of the fund is about education and about making these young folks more able to earn a living, isn't it? Pretty much any career choice has continuing education. Also, there are certainly plenty of non-uni classes that can be a boon to people. Wouldn't it be great if *everyone* had a class on minor car repairs, how to spackle a hole in the wall, cooking for one, self-defense classes, simple plumbing repair, and cooperative communication?

(Yes, I know... I'm thinking from the right side of my brain rather than the left).

Is that anything like a possibility?

If Grandma is beneficiary, then she gets the money. If Mom opened the account, then why did she name Grandma executor/trustee instead of herself?

Anyway, if the account says to be used solely for the children's college education and neither one attends college by age 26, then Mom gets to keep the money.

If the mother is still alive, how is the grandmother entitled to the account, if it were held jointly between the mother and father? The way I see it, there is still an account owner alive, and therefore the rightful owner. If Grandma were to be entitled, it would be to half, if anything.

Valid point Sunny but if the parents thought the money should be used for college, and specified this when they set up the trust, then that's what matters. If the kids want to travel, they need to do that on their own should mom not feel like funding it.

Sunny, you're trying to be reasonable here, but the fund specifically was set up for college, not a generalized "education".

Sorry. Comes from the teen telling me he doesn't want to go to college, he wants to travel the world. I told him fine, but he needs to save up for it because I'm not paying for it. I pay for college, I control the monies. I say education or medical and not anything else. Now, if he wanted a technical degree instead of a college degree, that would be fine. But it has to be not just generalized, a class here and a class there, it has to be a program.

Hey Guys this is not a Trust it is a simple bank account.... if it was a trust it would be legally sanctioned and Mom would not get any of it because it was supposed to be a college fund.

The Mom getting money kinda sucks for the kids because well it was supposed to be for them but the fact they aren't going to college kinda makes the kids well it makes them little bitches cause they should only get the money period if it's going to college. But again it's a Bank account not a Trust.

In the end, to profit on someones death is pretty rank. So if they get a fucking dollar they should appreciate it and then go love the family they have which is still here.

Actually, if mom got any of the money back she wouldn't be profitting so to speak, she is the one who put MOST of the money in the account and it appears she did so with the understanding it would be used in a very specific way.  The money is NOT the kids, the money is to pay for school.  To me, if the kids don't go to school then mom should get back what she put into it and the accumulated interest on that amount because she put the money in the account in good faith it would be used as intended.  The amount the dad contributed and the interest on same could then be split between the kids.   But i still don't get how she could have allowed herself NOT to be on the account in either as a account holder or a beneficiary, that was just dumb. 

Gram could really piss them off and hold the money in trust and put an age limit for example they get the money when they turn 40 or if they do this (i.e., go to college then they get the money before 40 to pay for school restrictions on it.  OR gram if it is an simple account with no legalities it has to be disbursed a certain way, could simply keep it and enjoy it herself.
