The basis for the Atlanta Journal Constitution story is that the white farmers wife said she believes Shirley Sherrod helped them, but thats not what Shirley Sherrod siad, was it. Shirley Sherrod testified to the NAACP meeting that she only did enough to make it seem like she was helping the white farmers but she held back all she could because they were white.

Exactly. She was screwed either way once that video came out. Personally, i dont believe she has a case for unlawful termination. However, she should sue the idiot who edited the video for lost wages and harrassment.

Malicious intent is going to be trivially easy to prove. The more interesting question is where did he get the video to edit. It was filmed by a videographer who was employed by the NAACP. That company is refusing to release the video to news outlets citing the NAACP's copyright. So whoever gave it to Breitbart stole it. It would be funny if he did time for receipt of stolen goods.
