OK, so lets get to examples- what laws and expansions of power are you referring to?

I'll throw you one little tiny example, Animu, and we'll see where it goes. Something where government has reached right into the daily lives of every one of us. By what Constitutional authority does the Federal gov't get to tell me what sort of light bulbs I can and cannot have in the bathroom where I keep the first aid kit?

Like most things of this sort it's the interstate commerce clause. Make the bulbs exclusively and provably only in the state where they are sold and used (impossible) and the feds would have no say.

First EO was issued by George Washington. And its taken this long to complain about them being unconstitutional?

yes and there were 10 presidents before george washington

HUH?

Moonhead -> RE: The Living Constitution (12/1/2010 12:39:50 PM)

Adam Weishaupt, whoever was the Pope at the time, King George, Doctor Who (probably a slightly younger William Hartnell as this was the 18th century), Pitt the Elder, Robspierre, Dean Swift, the Earl of Rochester, Alexander Pope and the Cyrano de Bergerac?

mnottertail -> RE: The Living Constitution (12/1/2010 1:07:23 PM)

They all suffered from siezures due to lightbulbs?

Moonhead -> RE: The Living Constitution (12/1/2010 1:08:47 PM)

Maybe, but they were the ten Presidents prior to Washington.

pahunkboy -> RE: The Living Constitution (12/1/2010 1:24:38 PM)

That should read,  WASHINGTON.   All in caps, 1 letter for each of the 10.

CerVeza -> RE: The Living Constitution (12/1/2010 1:35:36 PM)

I vote we should all wear a fez.

PeonForHer -> RE: The Living Constitution (12/1/2010 2:33:20 PM)

Yes, Ken. So the Supreme Court keeps saying. Then Kelo. Jesus.

It was a rhetorical question.

Actually, I am skeptical about the broad interpretation of the commerce clause; I know it has been repeatedly upheld, but I share the concern that it is used to enable the Federal govt to regulate virtually anything anywhere.

Although I think the law re: lightbulbs was a good one, I think it should have been better left to the states to regulate.

U.S. History: First American President

Now even though the office was called "President" this person did not have the powers we associate with a modern president.  He was more like the Speaker of the House.  His main role was to keep order in Congress.  He had no executive authority beyond presiding over Congress.

It was not until the Constitution was put in place in 1789 that the President had the powers we know today.  The first person to hold that office, of course, was George Washington.

For anyone who is curious, this link offers a list of the EO's since Washington's through 1897.

Btw, his established the minting and use of coins.

Not really the link I would have gone with, Tazzy. Maybe this one instead?

Now the thing is, I think the cfl's are pretty damn cool. I use them all over the place. We have an inconvenient switch in the garage, and just leave that light on all the time. The odd power outage aside, we got nearly three years of constant use out of one there. The upstairs hall, the porch lights, the other lights in the garage, bedside lamps and some overheads. Now the fixtures designed for decorator bulbs are a bit trickier, and then we have some other places in the house. The top of the stairs. The light over the kitchen sink. The already mentioned downstairs bathroom where I might be looking for bits of broken glass in a nasty cut. I want light in those places when I flip a switch, clear and strong light, and I don't want to wait for something less than that. In the winter, I like the extra degree or two of heat I get in my office when I turn the three 60's all the way up on the dimmer, and the dimmer is fine to reduce energy usage in the hot months.

For a government that is supposed to have limited rights, granted to it by the people, this just strikes me as an awfully personal sort of intrusion.

Forgive me for banging this drum yet again...but lets be clear-

The Presidents Bush and Obama have asserted their right to have you or any other American citizen summarily shot without so much as a trial or even public charge.

Yet it is the restriction on lightbulbs that strikes you as an "awfully personal sort of intrusion"??

TheHeretic -> RE: The Living Constitution (12/2/2010 8:38:03 PM)

War is hell, Animu, and I didn't see a sunset clause in the light bulb ban.

Yes. I am completely ok with our government killing people. Go start a thread, if you like.

AnimusRex -> RE: The Living Constitution (12/2/2010 8:47:07 PM)

Yes, giving the government unlimited power is what conservatives mean by "limited government".

I guess.

how about the President asserting that he has the right to imprison American citizens without trial?

I hear you. Fucking Roosevelt.

lets not forget lincoln.  (Habeous Corpus)

Psst, there was a state of rebellion (and an actual shooting war) taking place in the country.Granted the Supreme Court eventually ruled Lincoln in error...but by that time the need for his actions were reduced.
