ObamaCare Flatlines: ObamaCare Taxes Home Sales - Clobbers Middle-Class Americans

“I can make a firm pledge.  Under my plan, no family making less than $250,000 a year will see any form of tax increase.  Not your income tax, not your payroll tax, not your capital gains taxes, not any of your taxes,” ~President Obama, September 12, 2008

Beginning January 1, 2013, ObamaCare imposes a 3.8% Medicare tax on unearned income, including the sale of single family homes, townhouses, co-ops, condominiums, and even rental income.

In February 2010, 5.02 million homes were sold, according to the National Association of Realtors.  On any given day, the sale of a house, townhome, condominium, co-op, or income from a rental property can push middle-income families over the $250,000 threshold and slam them with a new tax they can’t afford.

This new ObamaCare tax is the first time the government will apply a 3.8 percent tax on unearned income.  This new tax on home sales and unearned income and other Medicare taxes raise taxes more than $210 billion to pay for ObamaCare.   The National Association of Realtors called this new Medicare tax on unearned income “destructive” and “ill-advised” and warned it would hurt job creation.

Ok what I wanna know is where the fuck is Brain?  After he spammed the board ever other fucking post pushing health care here we go!
Hows that for change people?
Ya bend over and spread em for the reprobates and bend over and spread em for the demoncrappers...
Enjoy the change!

WOW, your understanding of reality sometimes amazes even myself! The quote above is correct, except 'Obamacare' isn't what was passed in to law (that is, the version conservatives think is on the books). The Affordable Care Act was passed by CONGRESS, and signed with approve by President Obama. Mr. Obama's original plan, did not have the taxes, to which the quote was referring to, NOT, the ACA of 2010. But, Mr. Obama's Health Plan, wasn't what was signed in to law.

Second, what does houses have to do with the Affordable Care Act? Point out in that bill, where it talks about houses. Since your implying that was part of the ACA.

That is weird as hell.  The tax should apply to ALL forms of capital gains, of which stock, etc. appreciation should be the major component.  I wonder why the GOP focused exclusively on RE transactions?

Practically speaking, it's a future tax because most RE has done little if any appreciation over the past decade.  And only federal intervention has prevented a far worse RE debacle.  So to return some of that to the Treasury seems only fair to me.  As a taxpayer, I was forced to pay (in the future, to pay down the debt) to prop up the housing market.  Why should the beneficiaries of my forced largess get to keep the money?

That's not it.  I realize that the GOP has decided that they're supposed to block Obama and complain about him.  But the fact that they chose to talk ONLY about the RE aspects is what puzzled me.

DS,

JEfff is right when he says consider the source.  I don't have time to search the archives but we've had this same discussion before with the real one.

In the couple of minutes I had to search this the best I pull.  It does give a good break down of how the tax is actually applied.

Status: Partly true / Misleading
Example #1:
Email contributed by Kathryn C., April 15, 2010:
Fwd: Health Care Real Estate Tax Under the new health care bill - did you know that all real estate transactions are subject to a 3.8% "Sales Tax"? You can thank Nancy, Harry & Barack (and your local Congressman) for this one. If you sell your $400,000 home, this will be a $15,200 tax. Remember Obama's battle cry - take from the workers and give to the drones. ------------------------------

Example #2:
Email contributed by Barbara M., July 8, 2010:
FW: New Real Estate Sales Tax Under the new health care bill all real estate transactions will be subject to a 3.8% Sales Tax. The bulk of these new taxes don’t kick in until 2013 (presumably after Obama’s re-election). You can thank Nancy, Harry and Barack and your local Democrat Congressman for this one. If you sell your $400,000 home, there will be a $15,200 tax. This bill is set to screw the retiring generation who often downsize their homes. Is this "Hope & Change" great or what? We can vote the bums out in November and demand that they eliminate the bill or at the very least defund it. Then in 2012 repeal it.

Analysis: While not completely false, this message does convey the erroneous impression that the Health Care and Education Reconciliation Act of 2010 imposes a 3.8% sales tax on all real estate transactions.

It doesn't. Here's the real scoop, based on the best analyses I can find: Among the several new taxes and tax increases provided for in the final legislation (see Kiplinger for a concise summary) is a 3.8% tax on investment income for "high earners" only. Revenues from the tax, which goes into effect in 2013, will be dedicated to the Medicare Trust Fund.

So in your opinion its NOT the 3.8% thats false just where they are putting it.

They are re-venuing the tax scheme again.  Anything to keep ahead of people.

It is a transfer tax annexed to the "value" of your property that results in the commingling and converting "real" property through a syntax assault to the fictional value fiat to probate your estate.

It doesnt not affect me because I do not use federal reserve notes, I just thought you all might be interested.

I'm sure jeffffffffffffffffff and flc will be happy to detail that out for you.

You left this out:

http://urbanlegends.about.com/od/government/a/Health-Care-Real-Estate-Tax.htm

quote:

"High earners" are defined as individuals whose gross income is $200,000 or more, or married couples filing jointly with a combined gross income of $250,000 or more.

Moreover, the tax doesn't apply to the first $250,000 of unearned income for individual taxpayers (or $500,000 for married couples filing jointly).

Given that most taxpayers make less than $200,000 per year and most home sales don't clear profits exceeding $200,000, the vast majority of Americans won't be subject to this tax.

So how is this pledge broken?

quote:

“I can make a firm pledge. Under my plan, no family making less than $250,000 a year will see any form of tax increase. Not your income tax, not your payroll tax, not your capital gains taxes, not any of your taxes,” ~President Obama, September 12, 2008
