EXCELLENT POINT! But I am sure also that these guys in Stockton were up to more than a defaulted or ONE fraudulent loan.

Eternal, again, we saw only the top part of the search warrant. Do we know if this is a major case of fraud? Nope. Do we know about the woman's police record? Nope. We dont even know why the couple are estranged.

There are alot of if's and speculations, with little information.

According to everything I have seen the search was conducted with a valid warrant...which to me means that a judge signed off on it.Now if the warrant was obtained frauduantly or somehow flawed in another way...than there are legal recourses open to the citizen.....other than that though it is one of LEO's primary obligations....the going home safe part.
After all that is said and done...the warrant was kosher...law enforcement's first duty is to everyone's safety....if that means the guy got a little scared...better that than he reaches for something and ends up a little dead.....capice?

...it is good there was a warrant.     So that part is in order.

As to the comments about the DoE, the Office of Inspector General is the law enforcement arm of the Dept of Education.

This chap and his kids should however sue to discourage shoddy warrant execution. IF THAT'S WHAT IN FACT HAPPENED....
I would love to see some news indicating what the local police providing support saw.

Sure ... the DEPARTMENT OF EDUCATION will not arrest you or get a search warrant over a defaulted loan. If you default your student loan the co-plaintiffs on the collection suit filed will be the Government as 'Guarantor' or some form of interested party and a Lending entity as a 'trustee' or similarly distinguished. the Department of Education does not come after anyone upon a default of a loan. And for them to have any more power of attachment other than the one you sign away when you close on the loan (which limits them to grabbing government payments excluding social security benefits, such as tax returns). In order for them to go beyond that scope, they need additional; powers. If this guy is telling the truth, that he knew nothing before the event, then the feds were simply after the wife for something else.

   Because if that's where they thought she was, and this was about HER defaulted loan, that's where the SUMMONS & COMPLAINT in the civil matter was served. Then later Demand was made there, then a "Citation" to appear before a state or federal judge to answer as to why the judgement and execution has not been satisfied. And if THEN, the defendant does not show or satisfy the execution, THEN a body writ would execute.
   Given that a "Search Warrant" was supposedly exceuted. I would submit that the is NO SUCH THING  in terms of a civil matter. And default on ANY LOAN is ALWAYS a civil matter ... PERIOD


So my point is that something else is going on
