Not worried but just for the record though I vote 100% (R). Call me an idealist but I could never vote for the (D).  Maybe that's also a result of where I have lived.

I look at it this way muffin.  Different jobs require a different mindset.

Here is the simplest example.

The Public Defender NEEDS to be a hard core bleeding heart liberal, champion of the poor and opressed and all that.  Dem

The District Attorney, on the other hand, needs to be a straight and narrow, law and order kind of guy that will take no prisoners.  Rep

Other stuff isn't so clear cut but, hopefully, you get the idea.

Yeah, I'll just wait for the first significant news story about how some state employee majorly screwed up, cops to his drug habit in his public apology, and the papers run the sensationalism about how random drug testing would have prevented the whole incident.

How is that LP,being an asshole does not of necessity require one to use drugs....I have known many assholes who never used....conversely I have known some mighty bright guys who liked to spark up now and than.

Depends on what they're stoned on fargle.

I used to hang with truckers. They smoked pot to come down from the speedy stuff. Although government workers wouldn't have the same need to medicate in order to drive long hours to make more money and their dispatchers happy (log books be damned).

I bet it began with an L, ended with an E, and had another vowel in the middle?

I should add that I'm not claiming "all truckers use drugs" but just referring to the ones I hung around with in the 80's, and that their use was less recreational than work-related.

Long haul truckers usually use something a little stronger than coffee to keep themselves awake....let's start with over the counter caffiene pills.....and work our way up!

From the employer's view, what makes the state any different from the private sector when it comes to the employer's right to require drug testing?

I worked in plenty of white collar jobs in the private sector that required drug testing, even though my job did not involve public safety. If I didnt like that, I was free to move along down the line and work somewhere else.

Why is the ACLU picking a fight now?

I'm not in favour of drug testing. There are valid arguments that can be made for them in certain jobs, but I still see them as an unreasonable invasion of privacy.

In my view, they should be required to have reasonable cause for suspicion before being able to require a drug test in any position.

I can never listen to that without getting all teary-eyed. Some weird nostalgia thing. Or else hormones...

You seem to look at justice as a function of the "last man standing" as opposed to some moral absolute.

jus·tice
   /ˈdʒʌstɪs/ Show Spelled[juhs-tis] Show IPA
–noun
1.
the quality of being just; righteousness, equitableness, or moral rightness: to uphold the justice of a cause.
2.
rightfulness or lawfulness, as of a claim or title; justness of ground or reason: to complain with justice.
3.
the moral principle determining just conduct.
4.
conformity to this principle, as manifested in conduct; just conduct, dealing, or treatment.
