In most places, you don't *really* own all of your front yard. The municipality has the right to "shorten" your property line if they want to put in sidewalks or widen the road.

she organized her yard in raised planters.. I feel it safe to say that she wouldnt be neglecting yardcare

and putting in sidewalks actually, from what I can see, has nothing to do with the situation,.

sidewalks is a city/county thing.  we're talking about ONE homeowners right to plant what they want in their legally designated lot.

Yes GT, but some people think they should be able to tell you how your yard must look. And they get the gov on their side because of property values, and thus tax revenues.

When those crazies on this board talk about the fact that we are not free, they are correct. And if you hapen to move to Independence, Ohio, don't put a jetski in your driveway. I have no idea why, but you must comply.

yeah, I get that.. one time I couldnty go to my Dad's house to spend the night, because I was driving my pickup truck, with a camper on it, towing a trailer.. went against the HOA rules..

I think this shows people how they should be careful when they buy a home or land that they need to be mindful of the laws in the area, and the conditions of their neighborhood. Some people desire to live in a cookie cutter world and they will intentionally buy a home in a neighborhood that has special conditions for landscaping and how the facade is designed/kept. There are neighborhoods that even demand that you not have an RV in your driveway and tell you what color to paint your house. The city my brother lives in requires people to get a permit for yard sales, and only allows two a year per household. I am the type that would investigate local ordinances before I buy a home. It can really impact your quality of life to live in the wrong community... whether you are anal or the exact opposite of it.

Living in cities requires giving up a little of your freedom because you have to live closely with others. Is that fair? I think it is. I also think that if this lady really wants her garden in the front yard and the neighbors are mostly accepting and supportive of it, she should get signatures to that effect and it would go a long way in helping her present her defense.

At the end of the day, you want to be more free on your property, well you have to live away from other people because the way you decide to do things impacts your neighbors in such ways as property values, etc. Lets face it, not many of us want to live on a block with a hoarder, for example.

according to the article, the bylaw says the landscaping must be "suitable", but no definition of what suitable is, the word is obtuse and inadequate and renders the bylaw usless, imo. If the raised beds were filled with roses, would that be suitable? She is not a hoarder and the beds are neatly done, the problem it seems is that veggies are transitional plants wereas roses are permanent. Its totally silly and petty. Bylaws should be entirely clear to everyone (so that they can decide to live there or not), not used as a club when one persons standards are on mars. What is next, regulating what time of day you may walk your dog?

They do that on purpose so they can interpret it in whatever way is advantageous to them for a particular situation.

yep yep..

where my mom lives, the bylwaws say "NO LAUNDRY LINES" and "NO SHEDS"... yet many folks have them...  I am convinced that it is purely arbitrary...   Mom is allowed the laundry lines, but not a shed..

Well, we will see how this ends when she goes to court. I hope this case gets tossed out on its ear, should that happen tho, i would expect the city to next change the bylaw to be more specific (which it should be anyway).

To me yes..The tires would be pushing it but that's because tires have long been a worrisome breeding ground for mosquitoes. I hate them.

To me yes..The tires would be pushing it but that's because tires have long been a worrisome breeding ground for mosquitoes. I hate them.


I know a guy here in SoCal that has most of his front yard covered with rocks, he has the odd tree but its mostly rocks,.. rocks... rocks. Rocks and gravel driveway, much easier to maintain.

In some cities here they will basically pay you to tear out your lawn and put in more drought tolerant plants & mulch...

There was an older man in Florida that had a run in with the local government over the grass in his yard...to their dismay he pulled up every bit of grass and covered his whole front yard in concrete..spray painted his lawnmower gold and bolted it to the driveway.

I love stories like that. [:D]

Edit: Ya know, I've seen many front yards that were similar to that in Florida. (Small pebbles and concrete driveways instead of grass) They weren't to my taste but they still looked okay.

they have fake synthetic lawns that are supposed to look fairly life-like too but i have never seen one myself.

For me personally, a nice combination of very low maintainance plants and pebbles/cover would be good. But i still want my huge veggie garden! :)

I do not think "suitable" is useless. Lets say all of her neighbors were bothered by her choice of landscaping, would it be considered "suitable"? It probably wouldn't be... which was why I suggested that it would be advantageous to have her neighbors sign a petition in support of her landscaping choices... maybe there is a lot of people who think that it isn't "suitable" after all. I am with HK, it is kinda scraggly and not well planted.

I never said she was a hoarder... I said that these sorts of standards are set for a community because of people who do not respect others around them, hoarders are an example of such people. To be honest, the fact she has no grass or vegetation between her beds makes her yard unsightly. The bark added no color or brightness to the situation, and I think if she had grass between the beds it would be better accepted... a nice fence would have made it more attractive, and perhaps minimized the view of barren beds. I do not think I would like to live next door to it... it just isn't attractive, and not because it is veggies, but because it was not well done.

Who is the person on "mars" in this situation? The person that half assed developed a veggie garden in their front yard, or the people who did not like the way it looked? In my world, when you are the one out of step you are the one from another planet. Perhaps she should get her neighbors that support her position to vocalize it so that the local government knows that she isn't offending her entire block.

I would agree that the wording is ambiguous and as a citizen I would try to make the bylaws more clear.... although that is exactly what leads to 10,000 stupid regulations that no one knows about and no one follows.
