Does the ruling really mean that their testimony is blocked? It just means that they were not directly impacted by the sale of the gun. What relevant testimony could they even provide?

If they were allowed to be considered victims then any gun dealer could be considered a criminal (unless the special nature of these sales somehow creates a different class of crime).

Possibly for the civil case? Monetary compensation. Think OJ trial.

Possibly so that they could give a statement at sentencing.

Those are my guesses.

This is the wrong trial for that. This is a gun trafficking trial, not a trial over Agent Terry's murder.

From the same article:

quote:

Under the federal Crime Victims Rights Act, the Terry family would have the right to confer with prosecutors and speak at Avila's sentencing. Some speculate that the U.S. Attorney's Office may cut a deal with Avila in exchange for information to be used against his associates. That deal could mean little or no jail time, and a controversial sentencing day in the courtroom. Having the Terry family fight that deal, could further embarrass and complicate Burke's case.

Burke may also be trying to protect the federal government. The family may pursue a wrongful death claim against federal agents, including Burke himself.

"If the evidence shows Brian's death was proximately caused by the negligence of government, there may be a cause of action," said Paul Charlton, the family's attorney. Coffey says that puts Burke in a tough spot.

"The government's already been put on notice that they might be facing a wrongful death action by the family. And you have to wonder if the government's efforts to deny the family the status of 'crime victims' is part of a strategy to avoid legal responsibility for some of the tragic mistakes of Operation Fast and Furious," he said.

Burke refused comment when asked why he opposed the family’s motion and his possible conflict of interest.

If you were selling illegal weapons to a drug cartel and someone was killed with one of them do you think that the U.S. Attorneys Office prosecutors would bar the dead persons family from testifying, giving victim impact statements at your sentencing?

Its one set of rules for administration officials, and a completely different set of rules for everybody else.

I care about that, it matters to me.

Oh yeah, I can see all the women home alone while their husbands are "down the pub" flicking furiously through the channels trying to find a political debate thousands of miles away!
Suuuuuuure.

Haven't you noticed, Popeye?  Our politics and internal affairs are a very popular soap opera overseas.  We're like Dallas.  They get to look in on our big houses, lavish lifestyles, economic freedom and social mobility, and just have hissy fits about it.  They get all personally invested in Bobby, and they hiss for J.R., and some even make dumb comments about who they support, and who they would never vote for, as if their opinion was even worth a half-pence in the final tally.

That's interesting.

How do you manage to maintain that big house and lavish lifestyle when you are on this board all the time?

TheHeretic -> RE: Govt Gunrunners Block Family Testimony (8/12/2011 10:50:08 PM)

I was speaking of the US collectively, RML, but personally, I have this habit of getting up and walking away from the computer, checking off a few items on the honey-do list, or perhaps doing the honey, and wandering back to the keyboard later.

Did you care to address the analogy, or do you need a wikipedia link to establish that there was a TV show called Dallas?
