Actually you can refuse, but if you don't you can be in worse shit. If you omit anything or lie about anything that can be considered perjury. In a civil case you simply refuse unless it has to do with finances.* They will usually not push the issue otherwise if you handle it right. However that is likely to change because most lawsuits are against big companies because there is noone else to sue.

If you are suing you have been wronged, you probably don't have alot of money. A lawyer working on a contingency can quit on you if you refuse to cooperate with discovery. That means you are on your own, and unless you get some hotshot motherfucker who wants to make a name for himself your odds are not so good. And most of them might be from the SPLC or the ACLU or something so I would be fucked because I wouldn't talk on the phone with either one of them with a ten foot pole. I would have to litigate myself. Yeah fun. Could I do it ? If so I might be fucked, if not I will be fucked.

That's where the money gets you. On top. It's a fucking shame I can't just tell you........ the side with the resources wins 90% of the time, unless someone REALLY fucks up.

* Years ago I purposely defaulted on a case because I knew once I got in there, to take the stand I would have to answer questions, possibly about where my money came from. Believe it or not I eventuall paid that off, but when I got the gaddamn time. Not live on the street until they were satisfied. Each case is different.

well if I'm not mistaken the op stated this was a protection from abuse case. Yes these types of cases are labeled as civil cases but in PA where I did protection from abuse cases it can quickly turn to a criminal case and the judge can still require such information from the parties. Like I said, that's in PA. I have no idea about anywhere else.

When i did pfa court I saw many a case where a party was given contempt of court until they turned it over or gave the information the judge was wanting.
so you go to fucking jail. there's a principle involved. there are greater and more important things in life than being in jail or not.

delete all files, empty recycle bin, format drive, delete partition, create multiple partitions, format, write over entire disk, format, write, format, write, format, delete partitions, create partiton, format, write, format, delete partition. and so on, do that a few times and you're safe from anybody short of the nsa.

No, $50 won't do it.

Once you overwrite a piece of data several times it is virtually unrecoverable.

The trick is to know how to overwrite a section of the drive. There are shredder programs that make it virtually impossible to recover the data.

Search Google for "Data Shredder" or "File Shredder" and you'll find some hits. The method you mentioned for deleting data under Windows just sends the files to the recycle bin. It does this by replacing the first letter in the file table with a null character (not Omega) then it sends a message to the recycler task to tell it where to find it.

Also, if you run linux, there are _lots_ of freeware programs to destroy data. If nothing else you can find utilities to really do a number on the drive: They rewrite exery bit with one, then with 0, then alternating 1's and 0's and then alternating 0's and 1's. It will do this as many times as you have time for before they slap handcuffs on you.

I, however, have a perfectly valid excuse for not handing over that information: I work with pharmaceutical automation and asking for my passwords runs afoul of HIPPA.

OK, but you have to make sure that those particular sectors/tracks/whatever are overwritten. And alternate ones and zeros won't quite cut it. The programs for the NSA security are not free usually, unless of ocourse,,,,,, umm I never heard of Linux programs being able to do that. Maybe they can.

But the null character used to be omega. So things change.

And if anyone's got such kickass software, delete my picture off CM. (other than CM staff). Remove all the history of places I've been on the internet. Remove all my email accounts. Remove my originating IP.

So really, things have changed. I was in possesion of software that claimed to be DOD proof. Never found out if it was. Don't really care. But the fact is that it's damn hard for regular people to hide their tracks these days. That's all.

Termyn8tor: I seem to remember that you take pride in keeping older computers running. That means you should have a copy of Norton's Disk Editor somewhere on floppy or CD-ROM.

That program will tell you what sectors are loaded with which data. It is no difficult trick to use the same information to actually overwrite those sectors.

Please note: This will not work with SSDs. They use onboard logic to do wear leveling. You can't actually access the individual sectors. But with EIDE or SATA drives this is a very simple process; it's been around for over 20 years.

As for erasing your internet tracks: How many people do you think know I use this nick on this site and can connect it to an IRL name? If you guessed zero you'd be almost correct.

You don't have access (or at least I don't without being very, very naughty) to internet logs. The people who keep those are every bit as paranoid as you or I. The trick to erasing your footprints on the net is to not create them in the first place. A judge would need to know my nicks in order to request passwords.

The "kickass" software can only erase data on your own PC. It can't do it without console access at servers, and even then if they have a backup protocol you are SOL. And if they have a really good backup program then you can't even nuke the site from orbit.

Oh, and flash-drives use the same wear leveling protocol as SSDs (it's pretty much the same technology) so don't put data you don't want found on one of those.

Norton's. Yes back when that company was worth a shit, I think the good dosk utilities did actually come from them. Was it them that had DODOVRIT.EXE or something like that ? Of course it had to boot off a floppy.

And then Xtree gold had a utility that supposedly would overwrite many times the SPECIFIC sectors and tracks that were used for the specific data you wanted destroyed. I doubt any of these would work through the Windows shell. But back then, it seemed like it could give you the kickass security of a totaly FDISK and format and all that, overwrite and all that shit, but only for specific files. Not being fro the DOD I wouldn't know for sure if it really worked. I have heard of them using depth multiplexed heads to read deleted dat even if it has been overwritten multiple times. I think the process uses the idea of getting the apparent data and nulling them with the underlying "noise". Then after error correcting the "noise" they can then hull that dat and go after the layer under that. It really is a fascinating subject, but the fact is, I don't believe anything will reall erase anything.

But that is not the point. Try to erase your online presence. Off how many servers ? Of where and what, most of which people wouldn't even know where to look ? Waste of time to evn try, unless you gwet into the witness protetion program but that is not so good. Ummmmm, in case you didn't know, the witness protection program does not work, your lifespan is about a year or two. And don't ask.

They really do have a recording of every phone conversation you ever had for the last bunch of years, no shit. But you don't have that much to worry about because they would need some sort of refernce point, because there is simply too much to look through to randonly search for shit. The search system is getting better but really, with the sheer volume of data you are fairly safe .

I didn't say that. It is a personal injury case. Guy was injured in a bus accident in 2007, absolutely no question the bus agency is liable. The issue is damages. Which means he has been fighting with the bus agency's asshole insurance company for 4 years!!! All to get money that he is obviously entitled to and no doubt needs. Turning over your passwords might seem like a small price to pay at that point. Anyway, the plaintiff's counsel did seek a protection order against supplying the passwords, but he lost. It wasn't a protection from abuse, it was a protective order regarding evidence.
Fucking insurance companies, I hate those bastards.

It probably could be made untraceable. I doubt if the plaintiff in this case had things set up that way though. He is Mr. Mormon with a bunch of kids and a respectable job. It never even occurred to him to hide his tracks, he never imagined he would be in an accident and some insurance company was going to fuck with him. When his lawyer was talking about all this in court, I was sitting there thinking this poor guy is the unluckiest man on earth. He is going to be a whole lot unluckier if they find a bunch of porn on his computer. Poor guy.

I find this entertaining because when people ask I tell them I  don't even have an email account. And of course I do, but have never told one provider my real name. Hell I didn't even tell my isp my real name(yay for places that still take cash) and now I don't even use my own isp I use someone elses. As for pics and other things that is pretty simple too. I went through this with my ex and pointed out to the court....I don't have a computer(which I did but let them prove it) and I don't have an isp, or an email(facebook,myspace,etc) When the ex said I did and he could prove it I than asked the court how they didn't know he made them, and they said they couldn't prove it. So it all got counted out as proof of anything.

My mistake then. One of your posts stated that the plaintiff moved for a protective order. In Pa a protective order is a protection from abuse order.
